Ordinance Number 922ORDINANCE NO. 922 ' AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING AND ADOPTING MUNICIPAL CODE SECTION 6-1.01. ADOPTION OF COUNTY ANIMAL CONTROL PROVISIONS TO REFLECT BY REFERENCE TITLE 4 OF DIVISION 1 OF THE CURRENT CODIFIED ORDINANCES OF THE COUNTY PERTAINING TO ANIMAL CONTROL, WELFARE AND LICENSE REQUIREMENTS INCLUDING PROVISIONS FOR BARKING DOG VIOLATION AND CIVIL FINE. WHEREAS, the City of San Juan Capistrano has entered into a contract with the County of Orange to provide the City with animal control and licensing services since the City incorporated in 1961; and WHEREAS, said contract stipulates that the City of San Juan Capistrano may adopt similar animal control and licensing regulations as adopted by the County of Orange for enforcement purposes; and WHEREAS, in order for the program to be enforceable within the City of San Juan Capistrano, the City has determined to amend the language in the City's municipal code to include all future County amendments by reference, unless ' otherwise specified in the City's municipal code, and at this time to adopt the County's "Barking Dog Ordinance" within its own municipal Code by reference. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Code Amendment. The full text of Title 6 Chapter 1 of the Municipal Code is hereby replaced in its entirety as follows: Section 6-1.01. Adoption of County animal control provisions. For the purposes of providing animal control, welfare and license requirements, Title 4 of the Division 1 of the Codified Ordinances of the County, adopted by the Board of Supervisors of the County on November 21, 2006, are hereby adopted by reference and made a part of this chapter as though set forth in this chapter in full. This adoption shall include all future County amendments, unless otherwise specified in this Municipal Code Chapter, and shall be known as the animal control provisions of the City. A copy of said County Ordinance shall be on file with the City Clerk of the City of San Juan Capistrano. Page 1 of 2 0922 SECTION 2. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 3. City Clerk's Certification The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk.
