ORDINANCE NO. 110
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO AMENDING ORDINANCE NO. 56,
RELATING TO UNDERGROUND PUBLIC UTILITIES
The City Council of the City of San Juan Capistrano does hereby ordain
as follows:
SECTION 1:
That Ordinance No. 56 of the City of San Juan Capistrano be and the same is
hereby amended by adding at the beginning thereof, immediately following the title
thereof the following paragraph:
"The City Council of the City of San Juan Capistrano does hereby ordain
as follows:"
SECTION 2.
Paragraph "C" of "Section 3.04" of Ordinance No. 56 is hereby amended to
read as follows:
"C. UNDERGROUND UTILITIES
Utility lines, including but not limited to electric, communications, street
lighting and cable television shall be required to be placed underground.
The subdivider is responsible for complying with the requirements of this
Section, and he shall make the necessary arrangements with the utility
companies for the installation of such facilities. For the purposes of this
Section, appurtenances and associated equipment such as, but not limited to,
surface mounted transformers, pedestal mounted terminal boxes and meter
cabinets, and concealed ducts in an underground system may be placed above
ground. The City Council may waive the requirements of this Section if
topographical, soil or any other conditions make such underground installa-
tions unreasonable or impractical. This Section shall not apply to utility
lines which do not provide service to the area being subdivided."
SECTION 3•
A new Section 8.06 is hereby added to read as follows:
"SECTION 8.06. APPLICATION AND EFFECTIVE DATE. Section 3.04, paragraph C,
as amended by this Ordinance shall apply to residential and commercial subdivisions,
and shall become effective as to all subdivisions which have not submitted a plan
of the proposed construction prior to the effective date hereof.
SECTION 4.
This Ordinance shall take effect and be in force thirty (30) days from and
after its passage, and prior to the expiration of fifteen (15) days after the

passage thereof, this ordinance shall be published once in the Coastline Dispatch,
a newspaper printed in San Juan Capistrano, County of Orange, State of California,
together with the names of the members of the City Council voting thereon.
