ORDINANCE NO. 106
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO
AMENDING SECTION 3 OF ORDINANCE NO. 63 TO PROVIDE
AUTHORITY FOR MAIN EXTENSION CHARGES AND AIL OTHER
CHARGES NECESSARY TO CONSTRUCT AND MAINTAIN ADEQUATE
SEWER SERVICE; AND DECLARING THE URGENCY THEREOF
The City Council of the City of San Juan Capistrano does ordain as
follows:
SECTION 1. Section 3 or Ordinance No. 63 is hereby amended to read
as follows:
"Section 3. Connection Charges, Sewer Service Charges, Main
Extension Charges and All Other Necessary Charges.
"The City Council may, by resolution, adopt sewer connection
charges, sewer service charges, main extension charges and all other
charges necessary to construct and maintain adequate sewer service
within the corporate limits of the City of San Juan Capistrano. Any
such charges shall be in addition to other sewer or industrial waste
charges or fees authorised by this Ordinance."
SECTION 2. This ordinance is an ordinance for the immediate preservation
of the public health and safety and the following is a declaration of the
facts constituting this urgency.
The City of San Juan Capistrano is embarking upon an urgently needed
expansion of its sewer system and neither Ordinance No. 63 nor Resolution
63-3-11-1 adopted pursuant thereto considers the allocation of equitable
costs of the necessary extension of sewer_ mains. The City proposes to amend
Resolution 63-3-11-1 to up -date certain sewer charges and this ordinance
contains the essential authority for a portion thereof. In order that the
public will be protected immediately, it is necessary that this ordinance
be adopted as;an urgency measure.
SECTION 3. This ordinance shall take effect immediately and within
fifteen (15) days shall be published in the Coastline Dispatch, together
with the names of the City Councilmen voting for and against the same.
