ORDINANCE NO. 101
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO
AMENDING ORDINANCE NO'S. 5, 45 AND 49 BY AMENDING
THE SECTIONS THEREIN REFERRING TO FRONT, SIDE AND REAR
YARD REQUIREMENTS AND DECLARING THE URGENCY THEREOF.
The City Council of the City of San Juan Capistrano does ordain as
follows:
SECTION 1. Section D, 3 of the R-1, the R_2 and the R-3 District
Regulations of Ordinance No. 45 as amended by Ordinance No. 49, is further amended
to add paragraphs (d) and (e) as follows:
(d) Swimming pools shall be constructed so as not to encroach into

the required front yard of a lot; such pools shall be located no closer than
five (5) feet to any rear lot line or side lot line; on the street side of either
corner lot or on a lot where the rear lot line abuts a side lot line, no
pool shall be located closer than ten (10) feet to such side lot line.
(e) Filter and heating systems for such pools shall not be located closer
than twenty (20) feet to any dwelling other than the owners.
SECTION 2. This ordinance is to be declared an urgency ordinance. Its
urgency is declared for the following reason: The present zoning and land
use ordinance of the City of San Juan Capistrano requires structural setbacks
which include swimming pools which presently require variances within areas where
this ordinance permits such structures.
SECTION 3. The City Clerk shall certify to the passage and adoption of this
ordinance by the City Council of the City of San Juan Capistrano at a regular
meeting held on the 26th day of October, 1964, and shall cause the same to be
published in the Coastline Dispatch within fifteen (15) days after its passage.
