ORDINANCE NO. 100
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO REGULATING AND CONTROLLING THE CON-
STRUCTION OF FENCES, WALLS USED AS FENCES, LATTICE
WORK SCREENS AND OTHER WINDBREAKS WITHIN THE REQUIRED
FRONT, SIDE AND REAR YARDS IN R_1, R-2, and R_3
DISTRICTS WITHIN THE CITY OF SAN JUAN CAPISTRANO AND
DECLARING THE URGENCY THEREOF.
The City Council of the City of San Juan Capistrano does ordain as follows:
SECTION 1. No fence shall exceed six (6) feet in height on or within all
rear and side property lines on interior lot lines, and on or to the rear of
all front yard setback lines.
(1) No fence, hedge or wall over three and one-half (3i) feet in height
shall be erected in front of the established setback lines in any front yard,
or in the side yard on the street side of either a corner lot or on a lot, the
rear line of which abuts the side line of an adjoining lot.
(2) No fence, hedge or wall in excess of three and one-half (312) feet
in height shall be erected within five (5) feet of the side property line on
the street side of any corner lot.
(3) Elevation and plot plans for fences and walls are required when the
slope of the property is more than one (1) foot in every eight (8) feet and
shall be approved by the appropriate department of the City.
(4) Height shall be measured from the average finished grade inside a
fence.
(5) Building permits are required for fences constructed of concrete, mas-
onry, brick or other comparable mterials if height of fence is to exceed three
feet (3)i construction of said fence shall be subject to the Uniform Building
Code of Orange County, current edition, as adopted by the City of San Juan
Capistrano.
SECTION 2. This ordinance is declared to be an urgency ordinance and will
become effective immediately upon passage. Its urgency is declared for the
following reason: That the present zoning and land use ordinance of the City
of San Juan Capistrano do not have any fence regulations at the present time and
such regulation is necessary for the general health, welfare and safety of
the community.
SECTION 3. The City Clerk shall certify to the passage and adoption of
this ordinance by the City Council of the City of San Juan Capistrano at a reg-
ular meeting held on the 26th day of October, 1964, and shall cause the same to
be published in the Coastline Dispatch within fifteen (15) days after its
passage.
