Ordinance Number 92356 ORDINANCE NO. 92 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO ESTABLISHING AND ADOPTING BY REFERENCE THE LICENSING AND REGULATION OF MERCHANT PATROL SYSTEM AND MERCHANT PATROLMEN OF THE COUNTY OF ORANGE BEING TITLE 5, aMSION 1, ARTICLE 5 OF THE CODIFIED ORDINANCES OF THE COUNTY OF ORANGE. The City Council of the City of San Juan Capistrano does ordain as follows: SECTION 1. There is hereby adopted by the City Council of the City of San Juan Capistrano for the purpose of licensing and regulating Merchant Patrol -- Systems and Merchant Patrolmen in the City of San Juan Capistrano, those certain ordinances of the County of Orange, State of California, known as "TITLE 5, DIVISION 1, ARTICLE 5 of the CODIFIED ORDINANCES OF THE COUNTY OF ORANGE." Three (9),popies of said Title 5 are on file with the City Clerk, and are open to public inspection. The same are adopted hereby and incorporated herein as though fully set forth in length. SECTION 2. The following amendments to said Article 5 are hereby made simultaneously with the adoption thereof to clarify its applicability to and administration by the City of San Juan Capistrano. a. Unless the content clearly indicates otherwise, the term BOARD shall mean the City Council of the City of San Juan Capistrano and all other officers mentioned therein shall refer to their respective counterparts, if any, in the City of San Juan Capistrano. b. Section 51.052 is hereby amended to read as follows: "Section 51.052. Patrol System license; fee. "Every person conducting a patrol system shall first procure a City license in addition to any State license required and pay a license fee of fifty ($50.00) dollars per year." c. That two (2) new sections are hereby added to Article 5 to read - as follows: "Section 51.6541. Bond required - Terms - Minimum liability. No license shall be issued unless the applicant files with the City a surety bond executed by a surety company authorized to do business in the State of California, in the sum of One Thousand Dollars ($1,000), conditioned for the faithful and honest conduct of his business by such applicant. Such bond shall be approved by the City Attorney as to form, execution and sufficiency of the surety. The conditions of such bond must be substantially such that the principal . 357 therein will faithfully conform to each and all ordinances of the City, and to each and all laws of the State, whether then in force, or which may thereafter be adopted, relating to the business of the applicant. The principal and surety named in said bond, and their successors and assigns, shall be jointly and severally bound unto the City and unto any and every person aggrieved or damaged by a breach of the conditions of said bond; and said bond shall not be void upon said recovery, but may be shed and recovered upon from time to time by any person aggrieved or damaged, until the whole penalty is exhausted. In the event that the total liability of the surety upon such bond falls below One Thousand Dollars ($1,000), applicant shall furnish an additional bond to keep the liability at a minimum of One Thousand Dollars ($1,000)." "Section 51.0542. Use of motor vehicle - Insurance required. If the applicant intends to, or does, operate any motor vehicles in the operation of his business, he shill file with the City Clerk an insurance policy fbr each of said vehicles, which shall include within its coverage, public liability to the extent of Twenty-five Thousand Dollars ($25,000) for the death or injury of one person, Fifty Thousand Dollars ($50,000) for the death of injury of two or more persons, and property damage in the sum of Give Thousand Dollars ($5,000). SECTION 3. This ordinance shall take effect and be in force thirty (30) days from and after its passage, and prior to the expiration of fifteen (15) days after the passage thereof, this ordinance shall be published once in the Coastline Dispatch, a newspaper printed in San Juan Capistrano, County of Orange, State of California, together with the names of the members of the City Council voting for or against the same.
