Ordinance Number 64249• ORDINANCE NO. 64 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO AMENDING ORDINANCE N0.35 BY INCORPORATING THEREIN PROVISIONS FOR THE LICENSING AND REGULATION OF EXCURSION TRAMS AND DEFINING THE SAME. The City Council of the City of San Juan Capistrano does hereby ordain as follows: SECTION 1. That Section 1 of Ordinance No. 35 be and the same is hereby amended by adding thereto at the end thereof the following; "The term EXCURSION TRAM shall mean and include one or mord vehicles, either singly or in tandem designed to carry passengers or towed by a suitable motor vehicle and used to transport passengers on a designated route or routes for the primary purpose of sight-seeing." "The terms EXCURSION TRAM STAND OR EXCURSION TRAM DEPOT shall mean and include a portion of the street designated by the City Council for the use of EXCURSION - TRAMS while loading or unloading of passengers between sightseeing trips." SECTION 2. That Section 1A of Ordinance No. 35 be and the same is hereby added immediately following Section 1 by adding the following: "SECTION 1A - That wherever the term "taxicab" or "taxicab stand" or ("taxicab stands") is used throughout this Ordinance, it shall include the terms "excursion tram", "excursion tram stand" or "excursion tram depot". SECTION 3. That Section 23 of Ordinance No. 35 be and the same is hereby amended by adding the following paragraph at the end thereof: "That the provisions of this Section do not apply to Excursion Trams, but that appropriate designation of the name of the owner of such Excursion Tram vehicles be placed thereon to the satisfaction of the City Council." SECTION 4. That Section 26 of Ordinance No. 35 be and the same is hereby amended by adding the following paragraph to the end thereof: "That stands designated by the City Council for Excursion Trams shall bear the -- following words; 'Excursion Trams Only' in white letters upon the entire surface of the otherwise red painted curb." SECTION 5. That except as amended by this Ordinance, Ordinance No. 35 of the City of San Juan Capistrano shall remain in full force and effect. SECTION 6. This Ordinance shall take effect and be in force thirty (30) days from and after its passage and prior to the expiration of fifteen (15) days after the passage thereof, this Ordinance shall be published once in the Coastline Dispatch, a newspaper printed in San Juan Capistrano, County of Orange, State of California, 250 together with the names of the members of the City Council.
