ORDINANCE NO. 44
AN ORDINANCE OF THE CITY OF _.
SAN JUAN CAPISTRANO ESTABL-
ISHING A SPECIAL GAS TAX
STREET I14PROVEMENT FUND.
The City Council of the City of San Juan Capistrano does ordain
as follows:
Section 1. To comply with the provisions of Section 196, Article
5 of Chapter 1 of Division 1 of the Streets and Highways Code, there is
hereby created in the city treasury a special fund to be known as the
"Special Gas Tax Street Improvement Fund."
Section 2. All moneys received by the city from the State of Cal-
ifornia under the provisions of the Street and Highways Code for the
acquisition of real property or interests therein for, or for engineer-
ing, or for the construction, maintenance or improvement of streets or
highways by the city shall be paid into said fund.
Section 3. All moneys in said fund shall be expended exclusively
for the purpose authorized by, and subject to the provisions of Section
194-202 of Article 5. Chapter 1, Division 1 of the Streets and Highways
Code.
Section 4. This ordinance is an urgency ordinance for the immedi-
ate preservation of the public peace, health and safety and shall take
effect immediately. The facts constituting the urgency are as follows:

The City of San Juan Capistrano became duly incorporated on the 19th
day of April, 1961, and its citizens must be provided with the public
services subject to the provisions of this ordinance in order to protect
their persons, property, health and well being and this ordinance is
necessary in order to make proper use of revenue already in the treasury
for such special purposes.
Section 5. The City Clerk shall certify to the passage and adoption
of this ordinance by the City Council of the City of San Juan Capistrano

at a regular meeting held on the 8*da,,y of January 1962 and shall cause
the same to be published in the Coastline Dispatch within fifteen days
after its passage.
Passed, approved and adopted this 8th day of January, 1962.
