Ordinance Number 309j grounds for the declaration of a forefeiture of this franchise and of all rights of grantee hereunder. Section 6. Said franchise is granted under the Franchise Act of 1937. Section 7. This ordinance shall become effective thirty days after its final passage unless suspended by a referendum petition filed as provided by law. Section 8. The grantee of said franchise shall pay to the city a sum of money sufficient to reimburse it for all publication expenses in- curred by it in connection with the granting thereof; such payment to be made within thirty days after the city shall have furnished such gr- antee with a written statement of such expenses. Section 9. The franchise granted hereby shall not become effective until written acceptance thereof shall have been filed by the grantee with the City Clerk. Section 10. The City Clerk cause this ordinance to be published once within fifteen days after its passage in the Coastline Dispatch, a newspaper of general circulation published and circulated in said city. First read at a regular meeting of the City Council of said city held on the 10th day of July, 1961, and finally adopted and ordered published at a regular meeting of said Council held on the 24th day of July, 1961, by the following vote: AYES: Councilmen: Bathgate, Chermak, Durnford, Olivares and Buchheim NOES: Councilmen: None ABSNE: Councilmen: Non Mayor of San Juan Capistrano ATTEST: City Clerk ORDINANCE NO. 30 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO 93 ADOPTING BY REFER'NCE THAT CERTAIN CODE KNOWN AS THE FIRE PREVENTION CODE RECOMMENDED BY THE NATIONAL .BOARD OF FIRE UNDERWRITERS, BEING THE 19$,3 EDITION THEREOF, TOGETHER 'WITH THE AUGUST 1954 AKIEMDMENTS THERETO AND THE SECONDARY CODES REFERRED TO THEREIN. The City Council of the City of San Juan Capistrano does hereby ordain as follows: SECTION 1. ADOPTION OF FIRE PREVENTION CODE. There is hereby by the City Council of the City of San Juan Capis- trano for the purpose of prescribing regulations governing conditions hazardous to life and property from fire to explosion, that certain co- de known as the Fire Prevention Code recommended by the National Board of Fire Underwriters, 85 John Street, New York 38, New York, being par- ticularly the 1953 edition thereof, and the whole thereof, save and ex- cept such portions as are hereinafter deleted, modified ar amended tog- ether with the August, 1954 Amendments thereto as recommended by the N- ational Board of Fire Underwriters, and the secondary code referred to therein of which code and Amendments not less than three (3) copies ha- ve been and are now filed in the office of the Clerk of the City of San Juan Capistrano, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the effective with the incorporated limits of the City of San Juan Capistrano. SECTION 2. ENFORCEMENT OF THE FIRE PREVENTION CODE. a. The Fire Prevention Code shall be enforced by the County Fire warden, and the State Forest Ranger having charge and jurdisdiction of fire control in the unincorporated area of the County of Orange. b. While enforcing the provision of this Code the County Fire Wa- rden and the State Forest Ranger shall have the �wwers of Peace Officers. SECTION 3. DEFINITIONS. Whenever the word "municipality is used in the Fire Prevention Code it shall be held to mean the City of San Juan Capistrano. Whenever the words "Chief of the Fire Department", "Chief of the Bureau of Fire Prevention or any inspector thereof" are used in the Fire Prevention Code they shall refer to the Fire Warden of the County of Or- ange and the State Forest Ranger having charge and jurdisdiction of fire control in the County of Orange. Whenever the terms "City Attorney" and "the Police Department are 94 used in the Fire Prevention Code, they shall refer to the District Att- orney and Sheriff of Orange County respectively. Whenever the terms "National Electric Code" and "Uniform Puilding Code" are used in the Fire Prevention Code, they shall refer to the E1- octrical Code and the Uniform Building Code of Orange County respectively SECTION 4. DELETIONS. Article 12, consisting of Section 12.01 to 12.06 inclusive, of the Fire Prevention Code are hereby deleted and shall be of no force or ef- feet within the City Limits of San Juan Capistrano. SECTION 5. ESTA':LISR`1ENT OF LIMITS WITHIN WHICH FLAMMABLE LIQUIDS AND BULK STORAGE OF LIG}UIFIED PETROLEUM GAS IS PROHIBITED OR RESTRICTED. The limits referred to in Section 15.2.01 and 20.06a of the Fire Pr- evention Code shall each be subject in each instance to the provisions of Ordinance No. 5, the Land Use Ordinance of the City of San Juan Cap- istrano. SECTION 6. NEW MATERIALS, PROCESSES"OR OCCUPATIONS WHICH MAY REQ'- UIRE PERMITS. The City Council, with the assistance of the County Fire ''garden, shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or oc- unancies which shall require permits, in addition to those now enumera- ted in said Code. The County Fire Warden shall psot such list in a co- nspicuous place in his of ice, and distribute copies thereof to intere- sted persons. SECTION 7. PENALTIES. Any person;. Siam or corporation violating any of the provisions of this Code or the lawful order of the County Fire Warden and the State Forest Ranker having charge and jurdisdiction of Fire Control in the un- incorporated territory of the County of Orange shall be deemed guilty of a misdemeanor and upon .onviction thereof shall be punished by a fine of not to exceed Five Hundred Dollars ($500.00) or by imprisonment in the County Jail for not to exceed six months or by both such fine and imprisonment. Each day that a violation continues shall be considered a separate and distinct offense. SECTION 8. VALIDITY. 95 The City Council hereby declares that should any section, sentence or word of this ordinance or of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the City Council that it would have passed all other portions of this ordinance independent of the eliminations herefrom of,any such portion as may be declared invalid. SECTION 9. DATE OF EFFECT. This ordinance shall take effect and be in force at the expiration of thirty days from and after its passage, and before the expiration of fifteen days after its passage it shall be published once with the names of the members voting for and against the same in the Coastline Dispatch a newspaper of general circulation published in the City of San Juan Capistrano.
