(SEAL) AYES: Councilmen: Bathgate, Chermak, Durnford, Olivares, Buchheim NOES: Councilmen: None ABSENT: Councilmen: None City Clerk Pro Tem ORDINANCE NO. 23 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO PROHIBITING THE PRACTICE OR E%HIBTION OF THE BUSINESS Oft ART OF ASTROLOGY, PALMISTRY, PHREN- OLOGY LIFE READING, FORTUNE TELLING AND SIMILAR PURSUITS; PROVIDING FOR PENALTIES HEREUNDER AMID DECLARING THE URGENCY HEREOF. SECTION 1. Fortune telling, mediumship, magic — Practice for co- mpensation prohibited. — It is unlawful in the City of San Juan Capis- trano for any person, firm or corporation to carry on, practice or pro- fess to practice the business or art of astrology, palmistry, phrenolo- gy, life -reading fortune telling, cartomancy, clairvoyance, clairaudie- C nee, crystal gazing, hy,motism, mediumship, spirit photography, spirit writing, spirit v6kces, spirit materialization, etheralization, prophecy augury, divination, magic necromancy, character reading, or fortune tell= ing by handwriting analysis, or other similar business or art and to de- mand or receive directly or indirectly a fee, gift, donation or reward for the exercise or exhibition of his, her or its art therin. SECTION 2. Fortune telling, spiritualism, magic — Exhibition for 47 consideration prohibited. No person shall give an exhibition of astro- logy, palmistry, phrenology, life -reading, fortune telling, cartomancy, clairvoyance, clairaudience, crystal gazing, hypnotism, msdiumship, spirit writing, spirit voices, spirit materialization, prophecy, augury, divination, magic necromancy, or other similar business or art, at any place where an admission fee, gift, donation or regard is charged, asked or received, directly or indirectly. SECTION 3. Fortune telling, spiritualism, magic — Teaching for consideration prohibited. No person shall teach or give instruction in astrology, palmistry, phrenology, life -reading, fortun9 telling, cartomancy, clairvoyance, clairaudience, crystal gazing, hypnotism, mediumship, spirit photography, spirit writing, spirit voices, materialization, etherealization, prophecy, augury, divination, magic, necromancy, or other similar business or art and demand, ask or receive, directly or indirectly, a gift, fee, donation or reward for such teaching or instance. SECTION 4. Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not to exceed $500.00, or by imprisonment in the County jail for a period not to exceed six months, or by both such fine and imprisonment. SECTION 5. This ordinance is an ordinance for the immediate preser- vation of the public peace, health and safety and the following is a declaration of the facts constituting the urgency. The City of San Juan Capistrano, a municipal corporation, became duly incorporated on the 19th day of April, 1961. On said date the rules, regulations and ordinances of the County of Orange that were in effect and operative in the area within the boundaries of the present City of San Juan Capistrano are no longer of any force or effect by reason of the incorporation of the city. In order that the public will be pro- tected immediately, it is necessary that this Ordinance be adopted as an urgency measure. SECTION 6. This ordinance shall take effect immediately and within fifteen days (15) shall be published in the Coastline Dispatch, together with the names of the City Councilmen voting for and against the same. SECTION 1., Rights Granted. A license certificate from the City issued as provided in this ordinance shall authorize the person to whom issued by himself or itself or unless otherwise expressly provided in this Ordinance, by bona fide employeestin the regular course of their employment, to engage in, carry I on, conduct, in the City, the business, trade, calling, profession, exhibition or vocation for which issued, during the life of such license certificate. No person shall engage in, carry on, or conduct in the City any business, trade, calling, profession, exhibition or vocation herein- after in this Ordinance named, without such license certificate therefor, issued as provided in this Ordinance or at a time other than authorized in the license certificate.
