Ordinance Number 1991 2 3 4 5 6 7 8 9 10 111 121 13 14 15 16 17 18 19 20 21' 22 23' 24 25 26'. 2711 28' 29 30 31 32 349 ORDINANCE NO, 199 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO ESTABLISHING A PLANNING COMMISSION AND DEFINING THE DUTIES THEREOF, AND REPEALING ORDINANCE NO. 188. THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES ORDAIN AS FOLLOWS: SECTION 1. Members of the Planning Commission. There is hereby created a City Planning Commission consisting of five (5) members, not officers of the City, appointed by the City Council. The City Council hereby desigiates the following officers of the City as advisory members of the City Planning Commission; the City Engineer and the City Attorney. Advisory members shall not have the right to vote on any matter before the Commission. Advisory members may designate a deputy to sit with the Commission in their absence. SECTION 2. Office, Each member of the Planning Commission shall be a resident of the City of San Juan Capistrano and shall be nominated by a City Councilman and appointed with the concurrence of the majority of the Council. The term of office shall coincide with that of the appointing Councilman; - a member may, nevertheless, be removed at any time, by a majority vote of the City Council. SECTION 3. Meetings. The said Commission shall meet regularly at least once each month, at a time and place to be fixed by resolution of the Planning Commission and shall hold such other meetings as from time to time shall becalled in the manner and form required by law. The aforesaid resolu- tion shall provide for the appointment of a Chairman or pre- siding officer, who shall be charged with and vested with the power and authority to conduct said meetings in an orderly and efficient manner. To this end, any person,- who, while in attendance at any Commission meeting, uses profane language, or language tending to bring the Commission, or any of its members, or any official of the City into contempt, or any person who persistently interrupts the proceedings of the Commission, or refuses or fails to be seated or keep quiet when ordered to do so by the presiding officer, shall be guilty of a misdemeanor and punishable by a fine not to exceed One Hundred Dollars ($100) or by imprisonment in the County Jail for a period not to exceed ten (10) days, or by both such fine and imprisonment. 35 II 21I3 I 4 5 61� 74, 8�9 10 11 12 13 14 15 16 17 18 19 20 22 23 24 25 26 27 28 29 30 31 32 In all matters and things not otherwise provided for herein, the proceedings shall be governed by Robert's Rules of Order", Revised Edition. However, no ordinance, resolution, proceeding, or other action of the Commission shall be invalidated, or the legality thereof otherwise effected, by the failure or omission to observe or follow said rules. SECTION 4. Compensation and Expenses. Each member of the Commission shall receive no compensation but shall be paid actual and necessary expenses while conducting busi- ness for the Commission. SECTION 5. Powers of Commission. The City Planning Commission shall have power, except as otherwise, provided by law: a) To recommend to the proper officers of the City, plans for the regulations of the future growth and develop- ment and beautification of the City in respect to its public and private buildings and works, streets, parks, grounds and vacant lots. b) To recommend to the proper office of the City, plans, consistent with the future growth and development of the City in order to secure to the City and its inhabi- tants sanitation, proper service of all public utilities, and transportation facilities. c) To make recommendations to any public authorities or any corporation or individuals of such City with refer- ence to the location of any proposed buildings, structures or works. d) To recommend to the proper officers of the City the approval or disapproval of maps or plats or subdivi- sions of lands. Every such map or plat shall, prior to its final approval or disapproval by the proper officers of the City be submitted to said Commission for its recom- mendation thereon to such officers. And such other things as sh4ll be necessary to carry out the provisions herein authorized and as provided by an Act of the Legislature of .the State of California, found in the Statutes of 1929, Chapter 838, at page 1805, as approved by the Governor of the State of California. SECTION 6. The City Clerk of the City of San Juan Capistrano shall certify to the adoption of this ordinance and shall, before the expiration of fifteen (15) days after the passage thereof, cause the same to be published 1� 2 3 4 5 6 7 8 9 10 11 12 13 14 15 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 351 once, with the names of the members of the City Council voting for and against the -same in a newspaper of general circulation.
