ORDINANCE NO. 196
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO ESTABLISHING CURFEW HOURS
FOR MINORS AND PROVIDING FOR THE ENFORCEMENT
THEREOF, REPEALING ORDINANCE NO. 15
The City Council of the City of San Juan Capistrano does
hereby ordain as follows:
SECTION 1. Minor defined: For the purpose of this chapter,
any person under the age of eighteen years shall be deemed a minor,
SECTION 2, Curfew hours: It shall be unlawful for any minor
to loiter, wander or play in or upon the public streets, alleys,
parkways or places open to the general public betweA the hours
of 10:00 p.m. and 6:00 a.m. unless such minor is accompanied by
a parent, guardian or other adult person having the legal control
and custody of such minor. The prohibitions herein shall not
apply to those minors attending an educational gathering or public
place of entertainment which has been consented to by such parent
or guardian. Nor to minors returning home from or enroute to such
places in a direct and expedient manner, nor minors enroute to or
returning from places of employment or errands of duty directed
by such parent or guardian, or an emergency situation,
SECTION 3, Enforcement: Every law enforcement officer is
hereby authorized and empowered to demand from any person who he
has reasonable cause to believe is in violation of this ordinance
that such person give his or her name, address, proof of age, name
of parent, guardian or adult having care or custody,of such person
if a minor as herein defined, and other information reasonably
necessary to determine whether such violation exists.
Any such minor found to be in violation of the provisions of
this chapter may be taken into custody by such officer and thereafter
may be released to the parent, guardian or other adult person having
the care and custody of such minor or may be dealt with in accordance
with the Juvenile Court Law of the State.
SECTION 1. This Ordinance shall take effect and be in force
thirty (30) days from and after its passage.
SECTION 5. The City Clerk shall certify to the passage and
adoption of this ordinance by the City Council of the City of San
-- Juan Capistrano at a regular meeting thereof held on the 26th day of
June, 1972, and shall cause the same to be published in the Coastline
Dispatch within fifteen (15) days after its passage.
PASSED, APPROVED and ADOPTED this 26th day of June, 1972, by the
following vote, to wit:
