TREES ON PUBLIC PROPERTY
AN ORDINANCE OF THE CITY
OF SAN JUAN CAPISTRANO
AMENDING ORDINANCE NO.248 (URGENCY)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Ordinance No. 248 is amended by the addition of
subsection D to Section 4.25.5 of Ordinance No. 115, as
follows:
"D. When trees, as herein defined, are located
on public property or public rights of way, the Tree
Inspector shall, upon receipt of an application for
removal or destruction, set the matter for a public
hearing to be held not more than twenty (20) days
from the date of the application. He shall, accord-
ingly, cause notice of such public hearing to be pub-
lished in a newspaper of general circulation in the
City of San Juan Capistrano one time, at least ten (10)
days prior to the date of said hearing. He shall, in
addition, post such notice upon each affected tree.
"The Tree Inspector shall establish and adopt
such procedures and other regulations as may be reason-
ably necessary to conduct the public hearing in an or-
derly and expeditious manner, and shall, in any event,
render his decision within ten (10) days after the close
of the public hearing.,-

SECTION 2. This is an emergency ordinance adopted pursuant to
Section 36937 (b) and (c) of the Government Code and shall take
effect immediately. The facts constituting the emergency are as
follows:
A. There are public works projects involving public
property upon which trees are located; these projects
must proceed toward construction within a reasonable
time, and a public hearing must be set immediately.
B. Some of the trees located on public property
relate to street improvement proceedings.
SECTION 3. The City Clerk shall certify to the adoption of this
ordinance and cause the same to be published once in a newspaper
of general circulation in the City of San Juan Capistrano with-
in fifteen (15) days following the passage thereof.
PASSED, APPROVED AND ADOPTED this 22nd day of January,
1975, by the following vote, to wit:
