ORDINANCE NO. 278
RELATING TO ZONING AND PLANNING
APPLICATIONS
AN ORDINANCE OF THE CITY OF SAN JUAN
CAPISTRANO DEFERRING THE ACCEPTANCE
AND PROCESSING OF CERTAIN ZONING AND
PLANNING APPLICATION, EXTENDING THE
PROVISIONS OF ORDINANCE NO. 265
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1: Ordinance No. 265 be and is hereby extended
until such time as all mandatory elements of the General Plan are
adopted by the City Council and all zoning ordinances are consis-
tent therewith„ or for the period of eight months from the date of
this Ordinance, whichever should terminate earlier.
SECTION 2: This ordinance is an interim urgency
ordinance for the immediate preservation of the public peace,
health, safety and welfare adopted pursuant to Section 65858 of
the Government Code, and shall, accordingly, take effect immedi-
ately. The facts constituting the urgency are as follows:
Since the adoption of Ordinance No.
265 the entire process for the ultimate
adoption of the mandatory elements of the
general plan fell behind the City's time
schedule particularly because of the extended
public hearings and evaluation of citizen
input. The City has, therefore, sought and
received an extension of time to January of
1975 within which to adopt its General Plan;
the process of instituting and completing
zone changes to comply with the aforesaid
General Plan will require extended and pro-
tracted preparation and further public
hearings prior to adoption.
The Council of the City of San Juan Capistrano is of the
opinion that this interim ordinance deferring the acceptance,
receipt and processing of certain planning and zoning applications,
adopted as an urgency ordinance, is necessary in order to permit
the City staff, Planning Commission and Council the time and
resources necessary to prepare, review and adopt the aforesaid
final elements of the General Plan, and to prepare, review and
adopt revisions to its planning and zoning ordinances necessary
to assure consistency therewith.
PASSED, APPROVED AND ADOPTED this 2nd day of October,
1974, by the following vote, to wit:
