ORDINANCE NO. 276
ESTABLISHING THE CITY OF SAN
JUAN CAPISTRANO AS.A BIRD SANCTUARY
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO
CALIFORNIA, PROTECTING BIRDS AND THEIR HABITAT
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. This City Council finds and determines that:
a. Birds ought to be protected for the benefit and
enjoyment of the City's residents and visitors;
b. As a part of nature's environment birds provide
pleasure and enjoyment to many of our residents
and visitors;
c. More particularly, Swallows in the City of San
Juan Capistrano have historical and cultural
significance renowned throughout the world; and
d. Birds are of great economic value as scavengers
that prey upon pests and insects.
SECTION 2. No person shall, accordingly, trap, hunt,
shoot, molest; injure, or kill any bird or damage, destroy, or
otherwise tamper with the nests or eggs of any wild bird within
the City of San Juan Capistrano, However, should the City Council
find and determine that certain birds have become so numerous or
destructive in a particular area so as to constitute a menace and
danger to the public health and safety, the City Council may provide
for such remedy as may be deemed appropriate under the circumstances.
Furthermore, nothing contained herein shall prevent farmers from
taking appropriate measures and action to protect and preserve his
crops or livestock.
SECTION 3. The City of San Juan Capistrano be and is
hereby estaEMsF_e_cT and designated as a bird sanctuary.
SECTION 4. This Ordinance shall take effect and be in
force third—days from and after its passage.
SECTION 5. The City Clerk shall certify to the adoption
of this Or ina3' nce and cause the same to be published in a news-
paper of general circulation in the City of San Juan Capistrano
within fifteen (15) days after its passage.
PASSED, APPROVED AND ADOPTED this 4th day of September,
1974, by the following vote, to wit:
