AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO AMENDING
ORDINANCE NO. 251 RELATING TO VEHICLE PARKING AND TRAFFIC
REGULATIONS UPON CERTAIN PRIVATE ROADS AND PARKING AREAS
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 2 of Ordinance No. 251 is amended to
read as follows:
"Pursuant to Section 21107.8 of the California Vehicle
Code, the off-street private parking areas and privately
owned streets located within the Mission Village Shopping
Center as depicted in Exhibit "A" attached hereto, be and
are hereby found to be open to the public and are hereby
declared to be subject to traffic regulation by the
Sheriff of Orange County or such other law enforcement
agency as may be designated by the City Council and to
Sections 21107.8(a) and (b), 22350, 25103 and 23109 of
the aforesaid Vehicle Code."
SECTION 2. DECLARATION OF URGENCY. This Ordinance affects
the public health, safety and welfare and shall, accordingly, take
effect immediately. The reason for the urgency is that the City has
heretofore adopted Ordinance No. 251 for the regulation of traffic
within the aforesaid private parking area; however, the Sheriff of
the County of Orange requires certain clarifications herein contained
for enforcement.
SECTION 3. The City Clerk shall certify to the adoption
of this Ordinance and cause the same to be published once in a
newspaper of general circulation within fifteen (15) days following
the passage thereof.
PASSED, APPROVED AND ADOPTED this 13th day of May, 1974, by
the following vote, to wit:
AYES: Councilmen Sweeney, Weathers, Nash, Heckscher and
Mayor Byrnes
