Ordinance Number 254ORDINANCE NO. 254 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO ESTABLISHING: THE DEPOSITORY FOR TUE GENERAL AND SPECIAL FUNDS OF THE CITY OF SAN JUAN CAPISTRANO, SPECIFYING PROCEDURES FOR DEPOSITS, DETERMINING AUTHORIZED SIGNATURES NECESSARY FOR WITHDRAWALS, AND REPS -LING ORDINANCES Nv. 23 and 30. THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Pursuant to Section 36522 of the Government Code the following special and general bank accounts are established: General Account at the Southern California First National Bank, San Juan Capistrano Branch; Payroll Account at the San Juan Capistrano Branch of the Security Pacific National Bank; 1911 Improvement District Account at the Bank of America, San Juan Capistrano Branch. SECTION 2. All moneys received by the City of San Juan Capistrano, or any of its officers, employees or agents shall be turned over to the City Clerk or City Treasurer. SECTION 3. The City Clerk or City Treasurer, shall, forth- with upon the receipt of any moneys received on behalf of the City of San Juan Capistrano, deposit all such funds in the General Fund of said City as set forth in Section 1 of this Ordinance, unless existing law requires the deposit of said moneys in a special fund. SECTION 4. Any funds received by the City Clerk or City Treasurer which, by operation of law or direction of the City Council, are required to be deposited in a Special Fund shall be deposited in such Special Fund as required by law or directed by the City Council. SECTION 5. All checks, drafts and other instruments obligating the City of San Juan Capistrano to pay money shall be signed by the Mayor and the City Treasurer; or by the Mayor pro -tem in the absence of the Mayor; or by the Deputy City Treasurer in the absence of the City Treasurer. SECTION 6. Any officer or employee of the City of San Juan Capistrano collecting or receiving money belonging to, or for the use and benefit of the funds to which it belongs. SECTION 7. Ordinances No. 20 and 50 and all other orid- nanece inconsistent herewith are repealed. SECTION 8. The City Clerk shall certify to the passage and adopting of this Ordinance by the City Council of the City of San Juan Capistrano at a regular meeting held on the 7th day of January, 1974, and shall cause the same to be published in the Coastline Dispatch within fifteen (15) days after its passage. SECTION 9. URGENCY. This ordinance is an urgency ordi- nance for the immediate preservation of the public's health, safety, and welfare, and shall take effect immediately. The facts constituting this urgency are as follows: 6:. This ordinance, having been given first and second reading, with adoption thereof on December 17, 1973, was intended by Council to take effect within thirty days, or January 17, 1974. In that it was inadvertently not published, Ccn.nczl'P timetable f— +ria ordinancc which has ^ direct effect on the public's welfare as it is affected by the City's ability to provide orderly and effective business transactions through its depository of funds, requires that said Ordinance No. 254 now take effect immediately to avoid undue delay in the implementation of its provisions.
