Ordinance Number 411ORDINANCE NO. 411 REZONE 80-2 (FRENCH AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING THE COMPREHENSIVE DEVELOPMENT PLAN ADOPTED BY ORDINANCE NO. 379, BY AMENDING THE DESCRIPTION AND PERMITTED USES ALLOWED FOR PLANNING SECTOR B TO INCLUDE INDUSTRIAL SERVICE USES THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds that: 1. The City's Environmental Review Board has reviewed the subject zone change application, has determined that the project will have a significant effect on the environment, has required the preparation of an Environmental Impact Report, and has otherwise carried out all requirements of the California Environmental Quality Act. (The environmental impact report prepared for the project has been certified as adequate.) 2. The proposed zoning is consistent with the land use, circulation and other designations shown for the property in the General Plan. The proposed uses are otherwise consistent with the goals and policies of the General Plan. 3. The development of the property under the proposed uses will conform to the development standards and other applicable provisions of Ordinance No. 379. 4. A duly -noticed public hearing has been held to receive and consider public testimony regarding the proposed amended uses for Planning Sector B. SECTION 2. Zone Change. Based on the findings set forth in Section 1, preceding, the City Council ordains that the Comprehensive Development Plan adopted per Ordinance No. 379 and amended by Ordinance No. 384 is hereby amended to allow industrial service uses within,Planning Sector B, Ortega Planned Community. Said amendment is designated herein as Rezone 80-2 and is more specifically depicted on Exhibit "A", attached hereto. Purpose and Intent "To create a high quality, planned unit industrial development designed in conformance with the General Plan. Types of uses meeting this intent are: (a) Large single -purpose industrial uses engaged in research testing, light manufacturing; (b) Industrial service firms which primarily provide support services to other industrial businesses; and, (c) Small-scale commercial services appropriate to the support of permitted industrial uses. Activities related to such development shall be limited to prevent the emission of harmful levels of air contaminants, noise, glare, vibrations, or other such features to neighboring uses and the surrounding environment." 2. Section VI C.2.b. Industrial Service Firms An industrial service is defined as a firm which as a matter of course does not do business with the general public, but rather provides a service to other business firms. Such service firms may include design, marketing, financial, data or computer services. Specific industrial service uses which may be permitted within the planning sector subject to Section VI.C.4.g., are, but not limited to „ the following: (a) Design and engineering firms which provide a support service to other business firms. (b) Mortgage banking and insurance firms where the business is a support activity for other office or business firms. (c) Medical testing or laboratories which support other medical facilities or offices. (d) Large offices, such as industrial corporate headquarters. (e) Industrial firms engaged in sales or services such as office supplies, office equipment and furnishings, computer sales/service/maintenance, and advertising agencies serving industrial clients. -2- EXHIBIT "A", CONTINUED Section VI C.2.b. (existing) Change to Section VI 2.c. 4. Section VI C.4.g. Architectural Design Concepts A. General industrial uses (such as manufacturing, assembly, testing, processing, warehousing) which occupy large flat -roofed -type buildings shall comply with the following design guidelines: The architectural theme for the planning sector should incorporate design features consistent with the intent of the early California Spanish heritage. It is recognized that due to large building mass, a typical early California design may not be fully accomplished. However, contemporary designs incorporating mission tile and stucco will not be acceptable. Building designs should be innovative and incorporate the use of both vertical and horizontal details consistent with the early California style. Integration of building materials and traditional design details should be carefully used to create an architectural statement reflective of the design theme for the planning sector. Such buildings are discouraged adjacent to the freeway. In the event any such building is proposed adjacent to the freeway, the building design shall reflect the traditional California Spanish theme, both in scale and attention to detail, so as to create an environmental and architectural setting consistent with the use. Industrial service firms, which by their nature are able to operate from office buildings, shall not be permitted within any building of the type allowed in Section A above. Buildings which are intended to be occupied by industrial service firms shall be designed in keeping with traditional spanish architecture, with full pitch barrel tile roofs and other details as specified in the City's Architectural Design Guidelines. Such buildings are encouraged adjacent to the freeway. -3-
