DECLARING INTENT TO FORM LANDSCAPE
MAINTENANCE DISTRICT - TRACT 7654
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, DECLARING INTENT TO FORM AN OPEN
SPACE MAINTENANCE DISTRICT FOR TRACT 7654
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Declaration of Intent.
The City Council has found and determined that the
public interest and convenience require the formation of an open
space maintenance district pursuant to Chapter 2.5, Division 1,
Title 5 of the California Government Code.
SECTION 2. General Description.
The exterior boundaries of the proposed district are
those portions of Tract 7654 designated and shown on the map and
diagrams which are a part of the Preliminary Report, dated March 11,
1980.
SECTION 3. General Description of Maintenance.
The open areas to be maintained or conserved are comprised
of parkways adjacent to public streets, natural drainage areas
and major slopes, and the proposed maintenance will consist of
irrigating, mowing, weed -control, fertilizing, clean up and
general maintenance of the grass, shrubs and trees planted within
the aforesaid boundaries.
SECTION 4. Annual Assessment.
An annual assessment may be levied to pay the costs and
expenses of the maintenance and conservation of the aforesaid
open areas. The annual assessment limit on the assessed valuation
of taxable land and improvements within the district shall be as
hereinafter set forth; such amounts shall be billed for and
collected as a part of the regular tax bills:
For each One Hundred Dollars ($100.00) of
Assessed Valuation ............................$0.65
SECTION 5. Protest Hearing.
A hearing on protests and objections to the formation
of the proposed district or to the proposed maintenance shall be
held in the Chamber of the City Council on June 18, 1980, at the
hour of 7:00 P.M., or as soon thereafter as the matter can be
heard.
Any owner of property liable tobeassessed for the
maintenance may Make written protest against the proposed
maintenance or against the formation of the proposed district or
bgth by filing a written protest with the City Clerk at any time
not later than the hour so fixed for the hearing.
SECTION 6. Publication and Posting of Ordinance.
The City Clerk shall publish and post copies of this
Ordinance at least 15 days prior to the date of the protest
hearing and shall comply with all notice requirements of Sections
50597 through 50600 of the Government Code of the State of
California.

SECTION 7. Effective Date.
This Ordinance shall take effect and be in force
thirty (30) days after its passage.
SECTION 8. Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted in the duly designated
posting places within the City of San Juan Capi S,trano within 15
days after its passage.
