ORDINANCE NO. 381
PROVIDING FOR REGULATING THE CONSUMPTION
OF BEVERAGES DURING PUBLIC GATHERINGS
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, PROHIBITING THE CONSUMPTION OF
BEVERAGES IN THE PUBLIC STREETS, SIDEWALKS OR
OTHER RIGHTS-OF-WAY FROM GLASS OR METAL
CONTAINERS DURING OFFICIAL CITY FIESTAS AND
RELATED PUBLIC ACTIVITIES AND REPEALING
ORDINANCE NO. 301 (URGENCY)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Repeal.
Ordinance No. 301 is hereby repealed.
SECTION 2. Prohibiting Consumption of Beverages.
It shall be unlawful for any person to sell, distribute,
consume or dispose of any beverage in glass, metal or other
containers which may, if thrown, broken or shattered, cause
injury or damage to person and/or property within the public
streets, sidewalks and other rights-of-way of the City of San
Juan Capistrano during fiestas, parades and other public activities
sanctioned by the City of San Juan Capistrano.
SECTION 3. Violation.
Every person who shall be in violation of this Ordinance
shall be guilty of a misdemeanor punishable by a fine of not more
than Five Hundred Dollars ($500) or by imprisonment in the County
Jail for a period of not more than six (6) months, or by both
such fine and imprisonment.
SECTION 4. Effective Date.
This is an urgency Ordinance adopted pursuant to
Section 36937(b) and (c) of the Government Code, and shall,
accordingly, take effect immediately. The facts constituting the
urgency are as follows:
Fiesta de las Golondrinas, a major festival in the
City of San Juan Capistrano, will take place
during the week known as "Fiesta de las Golondrinas",
which culminates in a parade to be held on the
last Saturday of each such week. The public
health and safety requires that this Ordinance be
in effect by the aforesaid Fiesta period.
SECTION 5. Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted in the duly designated
posting places within the City of San Juan Capistrano within 15
days after its passage.
