ORDINANCE NO. 376
REZONE 78-6 (BEAR BRAND RANCH)
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP
ADOPTED BY ORDINANCE NO. 293 BY PREZONING
TRACT 9390 EXCEPT LOT 41, TO 100 EL (LARGE
ESTATE, 100 -FOOT MINIMUM STREET FRONTAGE)
PRIOR TO ANNEXATION
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council finds that:
A. Proposed prezone Rezone 78-6 is consistent
with the 1.1 Very Low Density designation
on the General Plan Composite Land Use Map
and is otherwise consistent with the goals,
objectives, and policies of the General Plan.
B. The development of the subject property under
the proposed prezoning will conform to the
development standards and other applicable
provisions of the City's Land Use Management
Code, Ordinance No. 293.
C. The City's Environmental Review Board has
determined that the environmental impact
report previously certified for the project
adequately addresses the impacts of the
prezoning required to accommodate the project.
SECTION 2. The official zoning heretofore adopted on
September 17, 1975 by Ordinance No. 293 is hereby amended by
providing zoning prior to annexation for Parcel 3 in unincorporated
territory of the County of Orange, California, as shown on the map
filed in Book 115, Pages 14 and 15, of Parcel Maps in the office
of the County Recorder of said County, excepting therefrom, that
certain portion shown on Tentative Tract Map 9390 as Lot 41. The
new zoning shall be 100 EL (Large Estate, 100 -foot minimum street
frontage).
SECTION 3. This Ordinance shall take effect and be in
force 30 days after its passage.
SECTION 4. The City Clerk shall certify to the adoption
of this Ordinance and cause the same to be posted in the duly
designated posting places within the City of San Juan Capistrano
within 15 days after its passage.
PASSED, APPROVED AND ADOPTED this 15th day of
November 1 1978 , by the following vote, to wit:
AYES: Councilmen Hausdorfer, Schwartze, Thorpe,
Buchheim and Mayor Friess
