Effective Date. 31. Clerk's Certification. SECTION 1. Repeal. Ordinances Nos. 259 and 219 are hereby repealed. SECTION'2. Adoption of Uniform Fire Code and Amendments thereto. There is hereby adopted by the City Council of the City of San Juan Capistrano for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the Uniform Fire Code, 1976 Edition, as published by the International Conference of Building -1- 130 officials and Western Fire Chiefs' Association, and the whole thereof, including Appendices A through G thereof, save and except such portions as are hereinafter deleted, modified, or amended, of which Code not less than three (3) copies are now on file in the office of the City Clerk, and the same are hereby adopted and incorporated as fully as if set forth at length herein, and the provisions thereof shall be controlling within the limits of the City of San Juan Capistrano. ' SECTION 3. Section 1.216 Amended (Compliance with Recognized Standards). Section 1.216 of said Uniform Fire Code is hereby amended to read as follows: Compliance with Recognized Standards Section 1.216. Whenever this Code is inapplicable for any reason to any situation involving the protection of persons and property from the hazards of fire and explosion, the materials, methods of construction, installation, practices, or operations necessary to provide such protections shall, to a reasonable degree, be in accordance with nationally recognized and accepted standards, principles and tests and generally recognized and well established methods of fire prevention and control. SECTION 4. Section 10.114 Added (Malls). Article 10 of said Uniform Fire Code is hereby amended by adding Section 10.114 to read as follows: Malls Section 10.114. (a) General. Every mall shall be provided with exits directly to the exterior as required by the Building Code. (b) The clear and unobstructed exit width on each side of the mall shall be as required by the Uniform Building Code, but in no case be less than 10' wide. The clear area shall be defined, identified and maintained in a manner approved by the Chief. (c) No display, side show, exhibition or promotional activity or similar use shall be permitted in the center area of the mall unless there is first obtained from the Chief a permit to conduct such activity. Included with each permit application shall be a floor plan delineating the exact area to be used and showing location of all displays. (d) All the conditions of Article 26 of this Code shall be applicable when the mall is used for other than, and, or in addition to an exit corridor. (e) Not more than 30' between 10' wide cross -aisles shall be permitted except as required or permitted by the Chief. (f) All flammable material used as, or in conjunction with, a display, side show, exhibit, promotional activity or similar use which would tend to increase the fire and panic hazard shall be maintained in a flame retardant condition or similarly protected in a manner approved by the Chief. -2- (g) No use shall be permitted which by its nature will impede free and unobstructed exiting due to people congregating to witness or participate. (h) The use of flammable liquid, liquified petroleum gas, flammable bottled gases and other materials presenting an unusual fire hazard shall not be permitted as a part of, or in conjunction with, any mall, display, side show, exhibition, promotional activity or other similar use. (i) All automatic fire sprinkler systems shall be provided with approved alarm and valve supervision. SECTION 5. Section 12.102 Amended (Manufacture, Sale and Discharge of Fireworks). Section 12.102 of said Uniform Fire Code is hereby amended to read as follows: Manufacture, Sale and Discharge of Fireworks Section 12.102. (a) The manufacture of fireworks within the jurisdictional area is prohibited except under special permits as are required by local and state regulations. (b) The sale of safe and sane fireworks (as defined by section 12505 of the California Health and Safety Code) shall be permitted only under the following conditions: 1. No fireworks shall be sold before 9:00 a.m. on the first day of July, or after 10:00 p.m. on July 4th. Hours of Operation 9:00 a.m. - 10:00 p.m. 2. No application for a permit will be considered or granted which is not accompanied by a license issued by the State Fire Marshal of California. 3. The violation of any law pertaining to the sale of fireworks shall automatically render this permit void. 4. No person shall sell or offer for sale or discharge any fireworks within a distance of 100 feet of any pump or dispensing device for flammable liquids nor within 50 feet of any structure or tent. S. At least one approved water -type fire extinguisher must be provided for every 20 feet of stand frontage. 6. Temporary stands shall be constructed of materials equal to 28 -gauge sheet metal or 3/8 -inch exterior plywood. A minimum of two 30 -inch exits shall be provided and are to remain open during hours of sale. 0:15 132 No permit shall be issued for the sale of fireworks from a temporary fireworks stand unless the applicant therefor shall file with his application a cash bond in the sum of $25.00, the condition of which shall be as follows: That the fireworks stand be removed and the premises upon which it'was located cleaned of all debris of every description and the premises restored to the condition they were in prior to the erection of the fireworks stand by July 10 of each year. If the work of removal of the fireworks stand and cleaning the premises is not completed within the time herein provided, then in that event, the cash bond shall be deemed to be summarily forfeited in its entirety, and the City shall perform the work of removing the fireworks stand and cleaning the premises. In addition, a $25.00 business license fee payable to the City of San Juan Capistrano is required. No application for a permit for the sale of fireworks at a fireworks stand shall be considered or granted which is not accompanied by the written consent of the owner of the premises upon which it is proposed to locate the fireworks stand, consenting to the entry upon the premises by the City for the purpose of removing the fireworks stand and cleaning the premises in case the permittee shall default therein. No fireworks stand shall be located closer than 20 feet to the right-of-way line of any public road or highway, or at any location which does not otherwise meet the approval of the Director of Community Planning and Development. 10. No signs shall be erected or maintained in connection with a fireworks stand which shall create a traffic hazard. 11. Storage of fireworks shall be in the fireworks stand or at locations approved by the Orange County Fire Warden. Fireworks stands used for storage shall be under 24-hour supervision of an alert adult. No sleeping inside of fireworks stand will be permitted at any time. 12. "No Smoking" signs shall be posted in an easily visible location on all sides of fireworks stand.- No smoking shall be permitted within 50 feet of any fireworks stand. 13. No person shall allow any rubbish to accumulate in or within 25 feet where any fireworks are stored or sold. 14. At least one person 18 years of age or older shall be in attendance at all times. No person less than 16 years of age shall be permitted inside the stand. -4- 15. Any fireworks stand that is to be energized will require an electrical permit from the Building and Safety Division. 16. All persons buying fireworks shall be 16 years of age or older and it shall be illegal to sell fireworks to persons under 16 years of age. (c) After applications for permits are granted, sale, possession, use and distribution of fireworks for such display shall be lawful for that purpose only. No permit granted hereunder shall be transferable. SECTION 6. Section 13.206 Amended (Access Roadways for Fire Apparatus). Section 13.208 of said uniform Fire Code is hereby amended to read as follows: Access Roadways for Fire Apparatus Section 13.206. (a) Every building hereafter constructed shall be accessible to fire department apparatus by way of access roadways with all-weather driving surface of not less than 20 feet of unobstructed width, with adequate roadway turning radius capable of supporting the imposed loads of fire apparatus and having a minimum of 13 feet, 6 inches of vertical clearance. EXCEPTION: When there are not more than two Group R, Division 3, or M Occupancies as defined in the Building Code, the requirement of this Section may be modified when, in the opinion of the Chief, fire -fighting or rescue operations would not be impaired. (b) The required width of access roadways shall not be obstructed in any manner, including parking of vehicles, "NO PARKING" signs and/or other appropriate notice prohibiting obstructions may be required and shall be maintained. (c) The access roadway shall be extended to within 150 feet of all portions of the exterior walls of the first story of any building. Where the access roadway cannot be provided, approved fire protection system or systems shall be providedasrequired and approved by the Chief. (d) Where fire protection systems approved by the Chief are provided, the above required clearances may be modified. (e) The Chief shall have the authority to require an increase in the minimum access widths where such width is not adequate for fire or rescue operations. -5- 134 SECTION 7. Section 13.209 Added (Premise Identification). Article 13 of said Uniform Fire Code is hereby amended by adding Section 13.209 to read as follows: Premise Identification Section 13.209. Approved numbers shall be placed on all new and existing premises in such a position as to be plainly visible from the street or road. Said numbers shall be not less than 3 inches in height. SECTION 8. Section 13.301 Amended (Installation). Section 13.301 of said Uniform Fire Code is hereby amended to read as followse Installation Section 13.301. (a) The Chief shall designate the type and number of fire appliances to be installed and maintained in and upon all buildings and premises in the jurisdiction other than private dwellings. This shall be done according to the relative severity of probable fire, including the rapidity with which it may spread. Such appliances shall be of a type suitable for the probable class of fire associated with such building or premises and shall have approval of the Chief. (b) In occupancies of an especially hazardous nature, or where special hazards exist in addition to the normal hazard of the occupancy, or where access for fire apparatus is unduly difficult, additional safeguards may be required, consisting of additional fire appliance units, more than one type of appliance, or special systems suitable for the protection of the hazard involved. Such devices or applianes may consist of fire hydrants, automatic fire alarm systems, automatic sprinkler or water spray systems, standpipe and hose, fixed or portable fire extinguishers, suitable asbestos blankets, breathing apparatus, manual or automatic covers, or carbon dioxide, foam or other special fire extinguishing systems. Where such systems are installed, they shall be in accordance with the applicable standards of the National Fire Protection Association. (c) An approved water supply capable of supplying required fire flow for fire protection for the required duration shall be provided to all premises upon which buildings or portions of buildings are hereafter constructed. When any portion of the building protected is in excess of 150 feet from a water supply on a street, there shall be provided, when required by the Chief, fire hydrants and mains capable of supplying the required fire flow. 135 Water supply may consist of reservoirs, pressure tanks, elevator tanks, water mains, or other fixed system capable of supplying their required fire flow for the required duration. In setting the requirements for fire flow, the Chief may be guided by the standard published by the Insurance Services Office, "Guides for Determination of Required Fire Flow". The location and number of fire hydrants connected to a water supply capable of delivering the required fire flow shall be provided on the street or on the site of the premises to be protected as required and approved by the Chief. The type of fire hydrant shall be in accordance with the appropriate water company standard plan if public. Private fire hydrant type shall be approved by the Chief. All hydrants shall be accessible to the fire department apparatus by roadways meeting the requirements of Section 13.208. (d) When fire protection facilities are to be installed by the developer, such facilities including all surface access roads shall be installed and made serviceable prior to and during the time of constructions. When alternate methods of protection, as approved by the Chief, are provided, the above may be modified or waived. (e) All fire alarm systems, fire hydrant systems, fire -extinguishing systems (including automatic sprinklers), wet and dry standpipes, basement inlet pipes, and other fire protection systems and appurtenances thereto shall meet the approval of the fire department as to installation and location and shall be subject to such periodic tests as required by the Chief. Plans and specifications shall be submitted to the fire department for review and approval prior to construction. (f) All required fire hydrants, if public, shall be in accordance with the appropriate water company's standard plan. Private hydrants shall be of the type approved by the Chief. (g) All premises where dwellings or portions of dwellings are hereafter constructed shall be provided with street fire hydrants as may be required by the Chief. The type and location of such fire hydrants shall be as designated by the Chief. SECTION 9. Section 13.302 Amended (Maintenance). Section 13.302 of said Uniform Fire Code is hereby amended to read as follows: Maintenance Section 13.302. (a) All sprinkler systems, fire hydrant systems, standpipe systems, fire alarm systems, portable fire extinguishers, and other fire 7 136 protective or extinguishing systems or appliances shall be maintained in an operative condition at all times and shall be replaced or repaired where defective. Fire protective or extinguishing system coverage, spacing and specifications shall be maintained in accordance with recognized standards at all times and shall be extended; altered or augmented as necessary to maintain and continue protection whenever any building so equipped is altered, remodeled, or added to. All additions, repairs, alterations and servicing shall be made in accordance with recognized standards. (b) The building owner shall be responsible for assuring that the fire and life safety systems required by Sections 1807 and 1907 of the Uniform Building Code shall be maintained in an operable condition at all times. Unless otherwise required by the Chief, quarterly tests of such systems shall be conducted by qualified persons approved by the Chief. A written record shall be maintained and be made available to the inspection authority. SECTION 10. Section 13.311 Amended (Wet Standpipes). Section 13.311 of said Uniform Fire Code is hereby amended to read as follows: Wet Standpipes Section 13.311. (a) General. Wet standpipes shall comply with the requirements of this Section. Occupancy classifications shall be as determined by the Building Code. Required wet standpipes extending from the cellar or basement into the topmost story shall be provided in Group A, Divisions 1, and 2.1 Occupancies with an occupant load exceeding 1000; in Groups B, H, I and R Occupancies four or more stories in height; and in Groups H and B, Divisions 1, 2 and 3 Occupancies having a floor area exceeding 20,000 square feet per floor. EXCEPTION: Wet standpipes are not required in buildings equipped with a complete automatic fire extinguishing system, except however, wet standpipes are required in all buildings used, all or partially, for the storage of high piled combustible stock. Wet standpipes are not required in basements or cellars equipped with a complete automatic fire -extinguishing system. -8- 13'7 Wet standpipes shall not be required in assembly areas used solely for worship. (b) Location. Wet standpipes shall be located so that all portions of the building are within 30 feet of a nozzle attached to 100 feet of hose. In Group A, Divisions 1, 2 and 2.1 Occupancies when the occupant load is more than 1000, outlets shall be located on each side of any stage, on each side of the rear of the auditorium and on each side of the balcony. (c) Detailed Requirements. 1. Construction. Wet standpipes shall be installed and tested as required for the water distribution system within the building. 2. Size. The size of the standpipe shall be not less than 2 1/2 inches in diameter when the height of the riser is 50 feet or more above the source and shall be not less than 2 inches in diameter when the height of the riser is less than 50 feet above the source. 3. Outlets. All interior wet standpipes shall be equipped with a 1 1/2 -inch valve in each story, including the basement or cellar of the building, and located not less than 3 feet nor more than 6 feet above the floor. 4. Water supply. The wet standpipe shall deliver not less than 50 gallons of water per minute at not less than 65 pounds per square inch residual pressure from each of any two outlets flowing simultaneously for 30 minutes. When more than one interior wet standpipe is required in the building, such standpipes may be connected at their bases or highest points by pipes of equal size. Where combination standpipes are installed, the 1 1/2 -inch outlet system may be supplied from the combination system with a 2 -inch connecting line. Pressure and gravity tanks. Pressure or gravity tanks shall have a capacity sufficient to furnish at least 100 gallons of water per minute for 30 minutes. Other such tanks shall be located so as to provide not less than 65 pounds per such square inch residual pressure from each of two outlets flowing simultaneously for 30 minutes. Discharge pipes from pressure tanks shall extend 2 inches from and into the bottom of such tanks. All tanks shall be equipped with a manhole, ladder and platform, drainpipe, water and pressure gauges, and a pressure relief valve. Each pressure tank shall be tested in -9- place after installation and proved tight at a hydrostatic pressure of 50 percent in excess of the working pressure required but not less than 150 pounds per square inch. Where such tanks are used also for domestic purposes, the supply takeoff for such purposes shall be located above the required capacity of such tanks. supply tanks shall be supported on non-combustible construction with not less than 3 -foot clearances over the top and under the bottom to adjacent construction. Approved pressure gauges shall be provided at pressure tanks and at the air pump. Fire pumps. Fire pumps shall be approved and shall deliver not less than the required fire flow and pressure. Such pumps shall be supplied with adequate power source and shall be automatic in operation. Where the wet standpipe system is supplied with water from the domestic supply of the building, approved fire pumps shall not be required provided the domestic pump used delivers the required fire flow. 7. Hose. Each wet standpipe outlet shall be supplied with an approved lined hose not less than 1 1/2 inches in diameter, capable of withstanding 500 psi test pressure. The lining and jacket shall be ozone resistant. Such hose shall be equipped with an approved variable fog nozzle. Hose provided for rack and cabinet use shall be designed to be folded in a pin rack unit. Hose reels, racks and cabinets. An approved and listed hose reel, or approved and listed semi-automatic hose rack, shall be provided and shall be located so as to make the hose accessible. The approved hose reel or rack shall be recessed in the wall or protected by suitable cabinets designed for such use. Pressure reduction. SECTION 11. Section 15.102 Amended (Definitions). Section 15.102 of said Uniform Fire Code is hereby amended to read as follows: Definitions Section 15.102. (a) BOILING POINT shall mean the boiling point of a liquid at a pressure of 14.7 psia (760mm). Where an accurate boiling point is unavailable for the material in question, or for mixtures which do not have a constant boiling point, for purposes of this classification, the 10 per cent point of a distillation performed in accordance with the Standard Method of Test for Distillation of Petroleum Products ASTM D86-62, may be used as the boiling point of the liquid. (b) BOIL -OVER shall mean the expulsion of crude oil (or certain other liquids) from a burning tank in which the light fractions of the crude oil burn off producing a heat wave in the residue, which on reaching a water strata may result in the expulsion of a portion of the contents of the tank in the form of a froth. (c) CHEMICAL PLANT shall mean a plant or that portion of a plant other than a refinery or distillery where flammable or combustible liquids are produced by chemical reactions or used in chemical reactions. -11- (d) COMBUSTIBLE LIQUID shall mean any liquid having a flash point at or above 140°F. and below 2000F., and shall be known as Class III liquid. (e) FLAMMABLE LIQUIDS shall be divided into two classes of liquids as follows: Class I shall include those liquids having flash points below 1000F., and subdivided as follows: Class 1-A shall include those liquids having flash points below 730F., and having a boiling point below 1000F. Class 1-B shall include those liquids having flash points below 730F., and having a boiling point at or above 1000F. Class 1-C shall include those liquids having flash points at or above 730F., and below 1000F. Class II shall include those liquids having flash points at or above 1000F., and below 1400F. When artificially heated to temperatures equal to or higher than their flash points, Class II and III liquids shall be subject to the applicable requirements for Class I or II liquids. The provisions in this Article shall also be applied to high flash point liquids which otherwise would be outside of its scope when they are so heated. (f) The flash point of liquids having a flash point at or below 1750F. (790C.) except for fuel oils and certain viscous materials, shall be determined in accordance with the Standard Method of Test for Flash Point by the Tag Closed Tester, ASTM D56-70 The flash point of fuel oil, and certain viscous materials having a flash point at or below 1750F., shall be determined in accordance with the Standard Method of Test for Flash Points by the Pensky-Martens Closed Tester, ASTM D93-71. (g) SWING JOINT shall mean any one of the following: 1. Extractor type foot valve housing with either a street elbow or a nipple and an elbow. 2. An elbow and a street elbow. 3. Two elbows and a nipple not over 6" long. (NOTE: Due to structural weakness, a "close" nipple shall not be permitted). -12- SECTION 12. Paragraph 4, Section 15.103 Added (Permits Required). Article 15 of said Uniform Fire Code is hereby amended to add a Paragraph 4 to Section 15.103, to read as follows: Permits Required Section 15.103. A person shall obtain a permit for the following: 1. Storage, handling or use of Class I flammable liquids in excess of one gallon in any dwelling or other place of human habitation; or in excess of 5 gallons in any other building or other occupancy; or in excess of 10 gallons outside of any building; except that no permit shall be required for the following: (i) For the storage of use of flammable liquids in the fuel tank of a motor vehicle, aircraft, motorboat, mobile power plant or mobile heating plant. (ii) For the storage or use of paints, oils, varnishes or similar flammable mixtures when such liquids are stored for maintenance, painting or similar purposes for a period of not more than 30 days. 2. Storage, handling or use of Class II or III liquids in excess of 25 gallons in a building; or in excess of 60 gallons outside a building, except for fuel oil used in connection with oil burning equipment. 3. Installation and use of equipment and premises for the storage, handling, use or sale of flammable or combustible liquids as herein stipulated. The required permit shall be obtained prior to the commencement of any work. 4. Extraction of flammable liquid from underground tanks. SECTION 13. Section 15.113 Added (Warning Signs). Article 15 of said Uniform Fire Code is hereby amended to add Section 15.113 to read as follows: Warning Signs Section 15.113 The Chief may require such warning signs as he deems necessary for the purpose of pointing out the hazards of storing, using or handling flammable liquids. SECTION,14. Section 15.216(c) Added (Testing of Underground Tanks). Article 15 of said Uniform Fire Code is hereby amended to add Section 15.216(c) to read as follows: -13- Testing of Underground Tanks Section 15.216. (c) All new underground tanks constructed of fiberglass or other material which is susceptible to physical damage shall be tested to a pressure of 5 psi for 30 minutes after being set in place. SECTION 15. Section 15.404(e) Added (Exit Facilities). Article 15 of said Uniform Fire Code is hereby amended to add Section 15.404(e) to read as follows: Exit Facilities Section 15.404. (e) Exit facilities shall be provided in accordance with the Uniform Building Code. SECTION 16. Section 15.404(f) Added (Drainage Facilities). Article 15 of said Uniform Fire Code is hereby amended to add Section 15.404(f) to read as follows: Drainage Facilities Section 15.404. (f) Drainage facilities shall be provided.to direct flammable and combustible liquid leakage and fire protection water to a safe location away from building, any important valve, or adjoining property. Emergency drainage systems containing flammable or combustible liquids, connected to public sewers or discharing into public waterways shall be equipped with traps or separator tanks to prevent flammable or combustible liquids from entering the public sewer or waterway. SECTION 17. Section 15.703(f) Added (Extraction). Article 15 of said Uniform Fire Code is hereby amended to add Section 15.703(f) to read as follows: Extraction Section 15.703. (f) Extraction of fuels from underground storage tanks shall be through designated extraction lines only. Drafting fuel through a fill pipe is prohibited. EXCEPTION: Should conditions arise requiring removal of fuel from underground tanks by means other than through approved extraction lines and dispensers, the following shall be required prior to commencing the extraction: 1. Notification of the Fire Prevention Bureau 24 hours in advance of extraction. -14- 2. Fire department permit. 3. An on-site fire department inspection of equipment and methods to be used. only equipment approved by the Chief shall be permitted. SECTION 18. Section 15.705(e-4) Amended (Testing of Delivery Systems). Section 15.705(e-4) of said Uniform Fire Code is hereby amended to read as follows: Testing of Delivery Systems Section 15.705. (e) 4. After completion of the installation, the system shall be tested as provided in Section 15.216. SECTION 19. Section 15.709(b) Amended (Extinguishers). Section 15.709(b) of said Uniform Fire Code is hereby amended to read as follows: Extinguishers Section 15.709. (b) Extinguishers of a minimum classification of 20-A,B,C, shall be located so that no pump, dispenser or fill -pipe opening shall be a greater distance than 75 feet from such extinguishers. SECTION 20. Section 15.710(d-3) Amended (Dispensing). Section 15.710(d-3) of said Uniform Fire Code is hereby amended to read as follow: Dispensing Section 15.710. (d) 3. Dispensing of flammable or combustible liquids into the fuel tanks of marine craft shall be by means of an approved type hose, equipped with an approved automatic closing nozzle without a latch open device. NOZZLES FOR DISPENSING CLASS I LIQUIDS SHALL BE MANUALLY HELD OPEN DURING DISPENSING OPERATIONS. -- SECTION 21. Section 30.121 Added (Tents). Article.30 of said Uniform Fire Code is hereby amended to add Section 30.121 to read as follows: -15- 144 Tents Section 30.121. Air supported structures used for assembly purposes as defined in Section 30.102 shall be provided with poles, stanchions, cables, or similar equipment, as required by the Chief, which will prevent collapse of the structure upon those assembled therein. SECTION 22. Article 35 Amended (High Piled Combustible Stock). Article 35 of said Uniform Fire Code is hereby amended in its entirety to read as follows: Article 35 High Piled Combustible Stock Scope Section 35.101. This Article shall apply to the storage of high piled combustible stock. Factors such as: Method and height of stock piling, combustibility of materials, fuel load and rate of heat release, areas and size of piles, aisles, automatic fire -extinguishing systems, smoke removal systems, building construction and fire separations are considered in setting forth the provisions of this Article. Definitions Section 35.102. (a) High Piled Storage is defined as combustible materials in closely packed piles more than 15 feet in height or combustible materials on pallets or in racks more than 12 feet in height. For certain special hazard commodities such as rubber tires, plastics, some flammable liquids, idle pallets, etc., the critical pile height may be as low as 6 feet. (b) Commodity is deinfed as combinations of product, packing materials, and container. Permit Section 35.103. No person shall use any building or portion of a building exceeding 2500 square feet for the storage of high piled combustible stock without first obtaining a permit from the Chief. A floor plan showing the dimensions and location of stock piles and aisles shall be submitted upon application for a permit. Classification of Contents Section 35.104. EXCEPTION: Automatic fire -extinguishing systems may be provided only in the storage area when it is separated from the remainder of the building by a one-hour fire -resistive occupancy separation in accordance with the Building Code. (b) The design and installation of automatic fire -extinguishing systems shall conform to NFPA 13-1976, as modified by NFPA 231 - 1979, and/or NFPA 231C - 1975. (c) The fire extinguishing system shall be designed by a licensed engineer or approved designer. (d) The design of automatic fire -extinguishing systems for Special Hazard Commodities shall be as approved by the Chief. The Chief shall be guided by the standards and recommendations of the National Fire Protection Association, Factory Mutual Engineering and other nationally recognized fire protection authorities. -18- Building Area Limitation Section 35.106. Every portion of a building used for the storage of high piled combustible stock shall be separated into floor areas not to exceed 100,000 square feet by a two-hour fire -resistive occupancy separation unless the sprinkler system is completely supervised by an approved central station, remote station, or auxiliary alarm system in accordance with NFPA 71 - 1974, and NFPA 72 - 1975. Smoke Removal Section 35.107. (a) Smoke removal capability shall be provided in buildings protected by an automatic fire -extinguishing system and shall be designed to provide a minimum of six changes of air per hour at 100 percent exhaust to the outside. (b) The air handling system fans shall be controlled to shut down automatically in the event of fire in accordance with NFPA 90A - 1976, or by activation of the fire protection system. (c) The system shall be designed for manual activation and override of automatic shutdown by separate control switches from the main power switches to the building lights and equipment. (d) The control switches shall be located in an approved location and shall be clearly identified. (e) The fan capacity shall be based on an empty building. (f) There shall be a minimum of two separate fans located in different locations of the same fire areas of the building. EXCEPTION: In areas protected by an approved fire extinguishing system, roof vents and draft curtains may be provided in accordance with Section 35.108 in lieu of power smoke removal systems. Roof Vents, Venting Ratios and Draft Curtains Section 35.108. (a) Roof vents and draft curtains shall be installed when the contiguous area (minimum separation between areas is 60 feet) used for high piled combustible stock exceeds 2500 square feet. EXCEPTION: Areas protected by an approved fire -extinguishing system. =&*M (b) The design and installation of roof vents and draft curtains shall be as specified in the Building Code except as herein provided. (c) Vents shall be installed in the roof, except that perimeter venting in the exterior walls by the use of automatic opening windows will be permitted to vent roof areas within 75 feet of an exterior wall. The top of such windows shall be located within one foot of the roof or ceiling level and the windows shall be not less than 30 inches nor more than 60 inches in depth. Roof areas more than 75 feet from an exterior wall shall be provided with roof vents. Venting shall be provided in accordance with the following table: Hazard Vent Area to Minimum spacing Classification Floor Area Ratio Between Vent Centers Class I, II, III 1:100 120 feet Class IV 1:50 100 feet Special Hazard Commodities 1:30 75 feet (d) The minimum dimension of any roof vent shall be not less than 4 feet. (e) Vents shall consist of automatic roof vents or automatic opening windows equipped with a fusible link designed to release at 165 degrees or roof monitors with a minimum opening of 24 inches or roof openings covered with approved plastics that will melt when heated and drop out at 165 degrees. (f) Draft curtains shall be provided to aid the operation of roof vents. Draft curtains shall comply with the requirements of the Building Code except as herein provided. (g) Draft curtains shall be at least 6 feet in depth and shall be of approved For Class I, II, and III commodities, draft curtains shall divide the under -roof area into sections not to exceed 10,000 square feet. For Class IV and Special Hazard Commodities, draft curtains shall divide the under -roof area into sections not to exceed 6,000 square feet. Aisles Section 35.109. Aisles of not less than 44 inches in width shall be established to provide access to exits and fire department access doors. Access to Building Section 35.110. Access doors shall be provided at near ground level for firefighting purposes in accordance with the Building Code, except as herein provided. There shall be at least one door not less than 3 feet in width and not less -20- than 6 feet, 8 inches in height in each 100 lineal feet or major fraction thereof of exterior wall facing access roadways as required in Section 13.208. Metal roll-up doors are not acceptable for such purposes unless approved by the Chief. Standpipes Section 35.111. (a) A Class II standpipe system shall be provided for all high piled storage areas that are not protected by automatic sprinklers. One and one half inch hose connections complying with NFPA 13-1976, Section 3-7.6 shall be provided in high piled storage areas which are protected by automatic sprinklers. (b) Approved and listed hose =eels or approved and listed semi-automatic hose racks shall be provided and shall be located so as to make the hose accessible at all times. The reel or racks shall be recessed or protected by suitable cabinets designed for such use. SECTION 23. Storage of Flammable or Combustible Liquids Prohibited. (a) The limits referred to in Section 15.201 of the Uniform Fire Code in which storage of flammable or combustible liquids in outside aboveground tanks is prohibited are hereby established as follows: All areas of the City except those permitting such storage by appropriate zoning. (b) The limits referred to in Section 15.601 of the Uniform Fire Code in which new bulk plants for flammable or combustible liquids are prohibited are hereby established as follows: All areas of the City except those permitting such bulk plants by appropriate zoning. SECTION 29. BulkStorage of Liquified Petroleum Gases Restricted. The limits referred to in Section 20.105(al3of the Uniform Fire Code in which bulk storage of liquified petroleum gas is restricted are hereby established as follows: All areas of the City except those permitting such bulk storage by appropriate zoning. SECTION 25. Storage of Explosive and Blasting Agents Prohibited. The limits referred to in Section 11.106(b) of the Uniform Fire Code in which storage of explosives and blasting agents is prohibited are hereby established as follows: Principal business districts; closely -built commercial areas; heavily populated areas; and areas where suitable security cannot be maintained. SECTION 26. Appeals. Whenever any permit pursuant to this ordinance is denied, revoked or suspended, the applicant may appeal to the City Council within thirty (30) days from the date of the decision appealed. -21- SECTION 27. New Materials, Processes or Occupancies which may require Permits. The City Manager or his designee, the Chief and the Fire Marshal shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies, which shall require permits, in addition to those now enumerated in said code. The Fire Marshal shall post such list in a conspicuous place in the City Offices and distribute copies thereof to interested persons. SECTION 28. Violations and Penalties. (a) It shall be unlawful for any person, firm or corporation to violate any of the provisions of this code hereby adopted or fail to comply therewith, or to violate or fail to comply with any order made thereunder, or to build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder; or to fail to comply with an order by the City Council or by a court of competent jurisdiction within the time fixed herein. Any person, firm or corporation violating any of the provisions of this code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed, continued or permitted; and upon conviction of any such violation, such person shall be punished by fine of not more than five hundred dollars ($500.00) or by imprisonment for not more than six (6) months, or by both such fine and imprisonment. (b) The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. SECTION 29. Waiver of Provisions. In the event of any dispute or disagreement as to the administration of this Ordinance, the determination of the City Council of the City of San Juan Capistrano shall be final. The City of San Juan Capistrano reserves the right to waive, upon review and determination of the City Council, any provision of this Ordinance. SECTION 30. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. -22- SECTION 31. Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause same to be posted in the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
