ORDINANCE NO. 354
AMENDMENT TO ORDINANCE NO. 293 (PRIVATE
OR PUBLIC ELEMENTARY SCHOOLS IN CO DISTRICT)
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING ORDINANCE NO. 293, TO PERMIT
PUBLIC OR PRIVATE ELEMENTARY SCHOOLS REQUIRING NO
OUTDOOR FACILITIES IN THE CO (OFFICE COMMERCIAL)
DISTRICT SUBJECT TO APPROVAL OF A CONDITIONAL USE
PERMIT
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. FINDINGS
A. The City Council finds that the land use
classification "public or private elementary
schools requiring no outdoor facilities" lies
within the Purpose and Intent of the CO
(Office Commercial) District, Section 3.4.12
of Ordinance No. 293, if a conditional use
permit is approved for the establishment of
each such use.
SECTION 2. AMENDMENT
A. Based on the findings in Section 1, preceding,
Subsection 3.4.12.D of Ordinance No. 293 is
hereby amended by the addition of the
following conditional use:
"4. Public or private elementary schools
requiring no outdoor facilities"
SECTION 3. EFFECTIVE DATE
This Ordinance shall take effect and be in force 30
days after its passage.
SECTION 4. CLERK'S CERTIFICATION
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted in the duly designated
posting places within the City of San Juan Capistrano within 15
days after its passage.
PASSED, APPROVED AND ADOPTED this 17th day of
May 1 1978 , by the following vote, to wit:
AYES: Councilmen Schwartze, Buchheim
and Mayor Friess
NOES: Councilmen Hausdorfer and Thorpe
