ORDINANCE NO. 346
REZONE 77-11 (DAON DEVELOPMENT CORPORATION)
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP
ADOPTED BY ORDINANCE NO. 293 BY CHANGING THE
ZONING OF PROPERTY DESIGNATED BELOW FROM GM
(GROWTH MANAGEMENT) TO RS (SINGLE FAMILY) ,
RS(20,000) (SINGLE FAMILY, MINIMUM 20,000
SQUARE FOOT LOT SIZE) , ES (SMALL ESTATE) ,
EL (LARGE ESTATE) , RA (SMALL FARM) , OR (OPEN
SPACE RECREATION) , AND OS (OPEN SPACE
PRESERVATION)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council finds that:
A. The city's Environmental Review Board has reviewed
Rezone 77-11, has determined that it will have a
significant impact on the environment, has required
the preparation of an environmental impact report,
and has carried out all requirements of the
California Environmental Quality Act for the
project.
B. The zone change request is consistent with the 1.1
Very Low Density, 1.2 Low Density and 2.0 General
Open Space designations on the General Plan
Composite Land Use Map and is otherwise consistent
with the goals, objectives and policies of the
General Plan.
C. The development of the subject property under Rezone
77-11 will conform to development standards and
other applicable provisions of Ordinance No. 293.
SECTION 2. The Official Zoning Map heretofore adopted
on September 17, 1975 by Ordinance No. 293 is hereby amended by
changing the zoning of Assessor's Parcel Nos. 650-022-06,
650-022-12, 650-022-14, 124-240-89, and 124-240-90; designated
herein as Rezone 77-11, and more particularly depicted on Exhibits
A-1 and A-2 attached hereto, from GM (Growth Management) to RS
(Single Family) , RS(20,000) (Single Family, minimum 20,000 square
foot lot size) , ES (Small Estate) , EL (Large Estate) , RA (Small
Farm) , OR (Open Space Recreation) , and OS (Open Space Preservation) .
SECTION 3. This Ordinance shall take effect and be in
force 30 days after its passage.
SECTION 4. The City Clerk shall certify to the adoption
of this Ordinance and cause the same to be posted in the duly
designated posting places within the City of San Juan Capistrano
within 15 days after its passage.
PASSED, APPROVED AND ADOPTED this 18th day of
January , 1978, by the following vote, to wit:
AYES: Councilmen McDowell, Friess, Nash
and Mayor Heckscher
NOES: None
ABSENT: Councilman B,Weeney
