Ordinance Number 419f ORDINANCE NO. 419 AMENDMENT TO TITLE 9 OF THE MUNICIPAL CODE - ARCHITECTURAL PROJECTIONS IN THE IP DISTRICT AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING TITLE 9, SECTION 9-3.424, OF THE MUNICIPAL CODE, TO ALLOW ARCHITECTURAL PROJECTIONS TO EXCEED THE MAXIMUM HEIGHT LIMIT FOR THE IP (PUBLIC INSTITUTIONAL) DISTRICT THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds that: A. The City's Environmental Review Board has reviewed the Amendment as set forth herein, has determined that the Amendment will not have a significant impact on the environment, has accordingly issued a negative declaration and has otherwise carried out all requirements of the California Environmental Quality Act as amended. B. The ordinance amendment will provide a mechanism for maintaining high quality architectural standards where specific relief from the maximum height requirement of the IP (Public Institutional) District would more appropriately carry out the aesthetic considerations of the General Plan. SECTION 2. Text of the Amendment to Section 9-3.424 (Development Standards, Other Provisions) A. Introduction Based on the findings set forth in Section 1, preceding, the following amendment to the Municipal Code is hereby enacted: B. Amendment Subsection B.10is hereby added to Section 9-3.424, to read as follows: "Section 9-3.424B.10 Architectural Projections Exceeding Maximum Height Limitations of IP (Public Institutional). The Planning Commission may approve architectural projections (spires, towers, etc.) to exceed the maximum height limitations of the IP District during consideration of specific development plans. Consideration of allowing the architectural projection shall require the Planning Commission to review the development plans to insure that the following design objectives are present: "(i.) The architectural projection is consistent with the proposed design theme. "(ii.) The architectural projection is in scale with the mass of the building. "(iii.) The architectural projection shall have a reference to the historical treatment of such elements and the proposed use of the building. _1_ "(iv.) The square footage area of the architectural projection should not encompass more than one (1) percent of the total building area. "(v.) In no instance shall the architectural projections have a sign or other attracting device installed on its face. "(vi.) The architectural projection shall not include habitable square footage." SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause same to be posted in the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
