Ordinance Number 527ORDINANCE NO. 527 442 REZONE 84-6 (ORTEGA PROPERTIES) AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP ADOPTED BY ORDINANCE NO. 293 BY AMENDING ORDINANCE NO. 379 BY ADDING SUBSECTION "E" TO PRINCIPAL USES PERMITTED IN PLANNING SECTOR A-1 (CARETAKER'S UNITS AS ANCILLARY TO A PERMITTED COMMERCIAL USE) THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds that: 1. The City's Environmental Review Board has reviewed the subject zone change application, has determined that the project will not have a significant effect on the environment, has recommended issuance of a Negative Declaration, and has otherwise carried out all requirements of the California Environmental Quality Act. The City Council has reviewed and has concurred with that determination and certified issuance of a Negative Declaration. 2. The proposed amendment is consistent with the land use, circulation and other designations shown for the property in the General Plan. The proposed amendment is otherwise consistent with the goals and policies of the General Plan. 3. The development of the property under the proposed amendment will conform to the development standards and other applicable provisions of Ordinance No. 293 and Ordinance No. 379, as amended. 4. A duly noticed public hearing has been held to receive and consider public testimony regarding the proposed amendment to Ordinance No. 379. SECTION 2. Zone Change. Based on the findings set forth in Section 1, preceding, the City Council ordains that Ordinance No. 379, heretofore adopted on January 3, 1979, by Ordinance No. 379, be amended. Said amendment is designated herein as Rezone 84-6 and is more specifically described as follows: 1. Add Section 2.e to the Principal Permitted Uses for Planning Sector A-1, to read as follows: "Caretaker's residence as an ancillary use to the above principal permitted uses may be permitted provided it satisfies the following design and operational standards: -1- H— W "a. The unit is integrated into the overall project design and is subordinate ox- incidental rincidental to the primary use of the project. "Ll. Occupancy and use of the units shall be restricted to those individuals who either are owners of the project or are employees whose primary function is responsibility for administering, overseeing or maintaining security for the primary use of the site. "c. Said caretaker's facilities shall not exceed more than 20 percent of the total project square footage nor 1,800 square feet of living area for any site. "d. Property owners requesting inclusion of a caretaker's facility shall enter into a recorded agreement with the City that restricts said units to use by individuals as defined under Subsection (b), above, and requires development review of any proposal to convert said facility to another use." SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
