Ordinance Number 520ORDINANCE NO. 520 404 AMENDMENT TO TITLE 4 OF THE MUNICIPAL CODE - TRAFFIC REGULATIONS - SPEED LIMITS AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING PRIMA FACIE SPEED LIMITS BY AMENDING SECTION 4-6.501, ARTICLE 5, TITLE 4 OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE WHEREAS, California Vehicle Code Sections 22357 and 22358 provide that local entities may declare prima facie speed limits of more than 25 miles per hour on City streets on the basis of an engineering and traffic survey; and, WHEREAS, California Vehicle Code Section 627 defines an engineering and traffic survey to include a consideration of all of the following: 1) prevailing speeds as determined by traffic engineering measurements; 2) Accident records; 3) Highway, traffic, and roadside conditions not readily apparent to the driver; and, WHEREAS, the City of San Juan Capistrano has completed a new engineering and traffic survey pursuant to California Vehicle Code Sections 22357 and 22358. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. City of San Juan Capistrano 1984 Engineering and Traffic Survey. The City Council of the City of San Juan Capistrano finds and declares that the 1984 Engineering and Traffic Survey has been completed in full compliance with the requirements of the California Vehicle Code. The Survey consists of the Report dated August 1, 1984, entitled "City of San Juan Capistrano City -Wide Speed Limit Analysis" prepared by the firm of Basmaciyan-Darnell, Inc., which is on file in the City Clerk's Department. SECTION 2. Establishment of Prima Facie Speed Limits. Based on the 1984 Engineering and Traffic Survey for the City of San Juan Capistrano, Article 5, entitled "speed limits," Section 4-6.501 of the San Juan Capistrano Municipal Code is hereby amended to read as follows: -1- 405 "Article 5. Speed Limits "Section 4-6.501. Established. "Pursuant to the provisions of Sections 22357 and 22358 of the California Vehicle Code, prima facie speed limits in the City of San Juan Capistrano are hereby determined and declared as follows: "(a) Twenty -Five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be twenty-five (25) miles per hour: 11(1) Calle Arroyo from La Novia Avenue to Avenida Siega; "(2) Camino Capistrano from Del Obispo Street to Ortega Highway; "(3) Via de Agua from Camino Las Ramblas to Calle Delgado; 11(4) Avenida De La Vista from southerly end to Oso Road; "(5) El Camino Real from Forster Street to La Zanja Street; and, 11(6) Ortega Highway from I-5 to Camino Capistrano. "(b) Thirty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be thirty (30) miles per hour: 11(1) Avenida Aeropuerto from Camino Capistrano to San Juan Creek; "(2) Calle Aspero from Del Obispo Street to Peppertree Bend; and, "(3) Village Road from Rancho Viejo Road to Trabuco Creek Road. "(c) Thirty -Five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be thirty-five (35) miles per hour: 11(1) Calle Arroyo from Rancho Viejo Road to La Novia Avenue; 11(2) Camino Capistrano from San Juan Creek Road to Del Obispo Street; -2- 0941 OW "(3) Camino Capistrano from Ortega Highway to La Zanja Street; "(4) Del Obispo Street from Calle Aspero to Ortega Highway; "(5) La Novia Avenue from Ortega Highway to San Juan Creek Road; "(6) Camino La Ronda from La Novia Avenue to Paseo Establo; "(7) Rancho Viejo Road from Calle Arroyo to Ortega Highway; "(8) San Juan Creek Road from La Novia Avenue to Avenida La Mancha; and, "(9) Trabuco Creek Road from Rancho Viejo Road to Village Road. "(d) Forty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be forty (40) miles per hour: "(1) Alipaz Street from Camino del Avion to Del Obispo Street; "(2) Camino Capistrano from La Zanja Street to Junipero Serra Road; 1'(3) Camino del Avion from Del Obispo Street to Alipaz Street; "(4) Del Obispo Street from Camino del Avion to Calle Aspero; "(5) Camino Las Ramblas from the southerly City limits (I-5) to Rinkerry Lane; and, "(6) Rancho Viejo Road from Junipero Serra Road to the northerly City limits. "(e) Forty -Five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be forty-five (45) miles per hour: "(1) Camino Capistrano from the southerly City limits to San Juan Creek Road; "(2) Camino Capistrano from Junipero Serra Road to the northerly City limits; "(3) Del Obispo Street from the southerly City limits to Camino del Avion; -3- 4 O "(4) Rancho Viejo Road from Ortega Highway to ` Junipero Serra Road; and, 1.(5) SECTION 3. San Juan Creek Road from Camino Capistrano to La Novia Avenue." ve Findings in acie Speed Limits. f Prima The City Council hereby makes the following findings pursuant to California Vehicle Code Section 627(b)(3) in support of the prima facie speed limits set forth below: CAMINO CAPISTRANO (40 Miles per hour) La Zanja Street to Junipero Serra Road. The Council finds that the following road conditions justify this speed: -----This street borders E1 Camino Real Park which generates significant children pedestrian traffic, and young bicyclists particularly in the area of Oso Road to La Zanja Street; -----There are a number of pedestrian crossings in this area; -----This street narrows from four to two lanes and at this point is characterized by a sharp horizontal curve; -----This street is designated as a school route; (see page 22 of the 1984 Engineering and Traffic Survey) CAMINO CAPISTRANO (45 miles per hour) Junipero Serra Road to Northerly City Limits The Council finds that the following road conditions justify this speed: -----A very heavy number of bicyclists populate this two lane road; -----The road is striped for bicyclists, and the road is narrow; -----This is the only designated bike route from southerly Mission Viejo to the Dana Point beach area; -----There is heavy truck traffic on this road; -----There are several sharp horizontal curves on this road; (See page 22 of the 1984 Engineering and Traffic Survey) -4- 4C" DEL OBISPO STREET (40 miles per hour) Camino del Avion to Calle Aspero The Council finds that the following road conditions justify this speed: -----The street narrows from four lanes to two lanes; -----There are several schools along this road including Marco Forster Junior High, Del Obispo Elementary, and Community Presbyterian Pre -School; -----There is a significant lack of sidewalks along approximately 60% of the entire length of this street, from Windjammer Drive to Calle Aspero; -----The street is heavily trafficked by children as this is a designated safe route to school; there is also a substantial amount of walking by children in the bike lanes; -----There are sharp horizontal, reversing curves in this road; -----There are very high volumes of traffic on this road; -----There are several bus stops on this road. (See page 22 of the 1984 Engineering and Traffic Survey) DEL OBISPO STREET (35 miles per hour) Calle Aspero to Alipaz Street The Council finds that the following road conditions justify this speed: -----There is a 90 degree sharp horizontal curve occurring at the point that this road narrows from four lanes to two lanes; - -----This is a designated safe route to school; as such the road is heavily trafficked by children; -----The Capistrano Valley Christian Church and School border this street; -----There is heavy double parking, particularly at school hours; -----There are a number of pedestrians in the area; -----There is an important pedestrian crosswalk on this street at the location of Via Belardes/Paseo Carolina; 061M 4 0 -----There is a substantial amount of cross traffic arising from the commercial center at Alipaz Street; -----Bike lanes generate a great deal of bicycle traffic. (See page 22 of the 1984 Engineering and Traffic Survey) RANCHO VIEJO ROAD (40 miles per hour) Junipero Serra Road to Northerly City Limits The Council finds that the following road conditions justify this speed: -----This is a two-lane road without bike lanes or sidewalks, thus forcing bicyclists into the main body of the roadway; -----There are high volumes of traffic on this road; -----A narrow bridge restricts movement on this road; -----The Orange County Transit District bus line route No. 91 utilizes this road which results in a number of bus stops in the middle of the road; -----The road is not fully improved; -----There is heavy truck traffic on this road; -----There are no left turn pockets on this road. (See page 23 of the 1984 Engineering and Traffic Survey) VILLAGE ROAD (30 miles per hour) Rancho Viejo Road to Trabuco Creek Road The Council finds that the following road conditions justify this speed: -----The presence of horizontal curves restricts car movement; -----There is substantial pedestrian activity on this street; -----This is a residential area with substantial parking occurring which interrupts traffic. (See page 24 of the 1984 Engineering and Traffic Survey) CALLE ARROYO (25 miles per hour) La Novia Avenue to Avenida Siega 410 The Council finds that the following road conditions justify this speed: -----This is a designated route to schools (Ambuehl Elementary School) and is bordered by several parks; -----There is heavy pedestrian usage of the road over several foot crossings; -----There is a sharp horizontal curve in this road. (See page 21 of the 1984 Engineering and Traffic Survey) SAN JUAN CREEK ROAD (35 miles per hour) La Novia Avenue to Calle Cartagena The Council finds that the following road conditions justify this speed: -----This street also borders Ambuehl Elementary School, a significant pedestrian generator; -----This is a designated safe route to school; -----There are many bicyclists on this road; -----There is significant traffic congestion at this school; -----The roadway narrows from four to two lanes without sidewalk protection; -----There is a heavily used crosswalk at the Calle Cartagena intersection. (See page 24 of the 1984 Engineering and Traffic Survey) LA NOVIA AVENUE (35 miles per hour) Ortega Highway to San Juan Creek Road The Council finds that the following road conditions justify this speed: -----St. Margaret's School and ITOP School border this street; -----This is a designated route to school for children; -----The road narrows from four to two lanes; -----A portion of this road does not have sidewalks and is not fully improved; -7- -----There is heavy street parking in the St. Margaret's School area; -----There is heavy truck traffic on this road. (See page 23 of the 1984 Engineering and Traffic Survey) SECTION 4. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 5. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
