Ordinance Number 480ORDINANCE NO. 480 170 REZONE 82-9 (TEKMAR/AMRAN/EL PARADOR HOTEL) AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP ADOPTED BY ORDINANCE NO. 293 BY CHANGING THE ZONING OF ASSESSOR'S PARCELS NOS. 124-120-64 AND 124-120-65 FROM GM (GROWTH MANAGEMENT) TO SP (PRECISE PLAN) DISTRICT (TEKMAR/AMRAN/ E1 PARADOR HOTEL) THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds that: 1. The City's Environmental Review Board has reviewed the subject zone change application, has determined that the project will have a significant effect on the environment, has required the preparation of an environmental impact report, which has been certified as adequate, and has otherwise carried out all requirements of the California Environmental Quality Act. 2. The proposed zoning is consistent with the land use, circulation and other designations shown for the property in the General Plan as per GPA 83-1. The proposed zoning is otherwise consistent with the goals and policies of the General Plan. 3. The development of the property under the proposed zoning will conform to the development standards and other applicable provisions of the Municipal Code. 4. A duly noticed public hearing has been held to receive and consider public testimony regarding the proposed zone change. SECTION 2. Zone Change. Based on the findings set forth in Section 1, preceding, the City Council ordains that the official zoning heretofore adopted for Assessor's Parcels Nos. 124-120-64 and 124-120-65 on September 17, 1975, by Ordinance No. 293 be changed from GM (Growth Management) to SP (Precise Plan). Said zone change is designated herein as Rezone 82-9 and is more specifically depicted on Exhibits "A" and "B," attached hereto. -1- 1 F SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause same to be posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage. PRECISE PLAN 82-1 174 Purpose and Intent To provide for the precise regulation of land uses in order to facilitate implementation of the General Plan, particularly as it pertains to General Plan Amendment 83-1. To provide for the utilization of innovative land planning and building design as a means of achieving a high-quality project consistent with the preservation of major trees and topography of the site. Principal Uses and Structures Permitted 1. Hotel consisting of a maximum 300 rooms. 2. Support facilities which are limited to the following uses: (a) Convention/banquet facilities. (b) Restaurant and coffee shop. (c) Small retail shops incidental to the hotel. (d) Support services such as administrative offices, laundries, etc. 3. Any use not specifically listed in this Precise Plan shall be regarded as not being a permitted use, except as provided for in Municipal Code Section 9-3.303 (determination of permissibility of unlisted uses by the Director). Precise Plan The Precise Plan includes a site plan, landscape concept plan, architectural elevations, building materials and colors referenced herein as conditioned by AC 82-5 and per Exhibits 1-9 shall be considered precise. Building elevations for the future 100 -room addition shall be reviewed and approved by the City's Architectural Board of Review and Planning Commission. In addition, a traffic study shall be concurrently submitted with the building elevations identifying whether the traffic impacts discussed in the certified Focus EIR have changed. Exhibit "B," Page 1 of 11 1 ,7 5 -2- Precise Plan 82-1 D. Parkinq Provisions Parking for the hotel/convention facility may be phased in accordance with the following: 1. Phase I - Three hundred ninety parking spaces shall be provided to support a minimum 200 hotel rooms and support convention facilities. 2. Phase II - Ninety additional parking spaces shall be provided to support the final 10.0 -room addition. The total number of spaces to be provided for the complete facility shall be 480. E. Amendment of Precise Plan 1. The Director may approve minor modifications to the approved Precise Plan pursuant to Section 9-2.314. 2. The Planning Commission may approve modifications to the approved Precise Plan if the Commission determines that the modification is consistent with the overall purpose and general design of the originally adopted Precise Plan and that the integrity of the original project concept and plan is maintained. The amended Precise Plan shall then become the Precise Plan associated with the Specific Plan District designation on the official zoning map. 3. If the Planning Commission determines that the proposed amendment is not consistent with the overall purpose and general design of the originally adopted Precise Plan, a new zone change application will be required. Such zone change will be reviewed in the same manner as the initial application. F. Supplementary District Regulations The Supplementary District Regulations of Article 9-3.6 (signs, fence regulations, etc.) shall apply to this SP (Specific.Plan) District. However, specific -supple- mentary district regulations adopted as part of a Precise Plan as designated on Exhibits 1-9 and conditioned per AC 82-5 shall supersede such Article 9-3.6 regulations. G. Issues Not Addressed In cases where a standard, regulation, or other issue is not addressed in this Precise Plan, the appropriate provision of this Title 9 shall regulate.
