PROHIBITION OF DRINKING
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING CHAPTER 3, TITLE 5 OF THE
MUNICIPAL CODE PROHIBITING THE DRINKING OF
ALCOHOLIC AND FERMENTED MALT BEVERAGES ON PUBLIC
AREAS
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Amendment.
Section 5-3.02 is added to Chapter 3, Title 5 of the
Municipal Code to read as follows:
"Section 5-3.02.
Prohibition of Drinking
Alcoholic Beverages.
"The drinking of any intoxicating liquor or any
fermented malt beverage or the possession of any open
container which contains an intoxicating liquor or fermented
malt beverage is, unless specifically permitted by prior
written approval of the City, prohibited in the
following places:
"1. On any street, roadway, boulevard, alley,
parking lot, sidewalk or public way in the
"Downtown Area" of the City of San Juan
Capistrano;
(a) Downtown defined: The "Downtown Area"
is that portion of the City beginning at
the intersection of the Atchison, Topeka
& Santa Fe Railroad right-of-way and
La Zanja Street and continuing easterly
on La Zanja to E1 Camino Real; thence,
southeasterly along El Camino Real to
Acjachema Street and easterly along
Acjachema Street to Interstate 5 (San
Diego Freeway); thence southerly to the
Ortega Highway (State Highway 74);
thence northeasterly along the Ortega
Highway to La Novia Avenue and
continuing southerly along La Novia to
the creekbed of San Juan Creek; thence
southeasterly along the San Juan
Creekbed to its intersection with
Trabuco Creek; thence north following
the Trabuco Creekbed to Del Obispo
Street and easterly along Del Obispo to
the Atchison, Topeka & Santa Fe Railroad
right-of-way; and then north along the
Atchison, Topeka & Santa Fe Railroad
right-of-way to its intersection with
La Zanja Street.

areas of any commercial shopping center.
"3. On any grounds owned by or under the control
of a public school district within the City
of San Juan Capistrano, or within a distance
of 300 feet from any exterior boundary of
such grounds, except on private residential
property;
114. Within any public park, recreational area or
recreation facility owned and/or operated by
the City of San Juan Capistrano."
SECTION 2. Effective Date.
This Ordinance shall take effect and be in force thirty
(30) days after its passage.
SECTION 3. City Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted at the duly designated
posting places within the City of San Juan Capistrano within
fifteen (15) days after its passage.
PASSED, APPROVED AND ADOPTED this 21st day of
October , 1982 , by the following vote, to wit:
AYES: Councilmen Friess, Hausdorfer,
Schwartze, and Mayor Pro tem Bland
