Ordinance Number 594ORDINANCE NO. 594 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING VARIOUS PROVISIONS OF CHAPTER 1, "BUSINESS LICENSES;' OF TITLE 3, "FINANCE," OF THE MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Amendmentsto Chapter 1� "Business Licenses;' of Title 3, "Finance;' of the Municipal Code. A. Section 3-1.109. "Licenses: More than one business at the same location," is hereby amended to read as follows: "In the event any person is operating more than one business required to be licensed at the same location and under the same management, the license tax to be paid by such person shall be the full license tax for each business." B. Section 3-1.111. "Licenses: Duplicates." is hereby amended to read as follows: "The license collector shall make a charge of five ($5.00) dollars for each duplicate license issued to replace any license which has been lost or destroyed." C. Section 3-1.114. "Taxes: Payment," is hereby amended to read as follows: "All license taxes shall be due on January 1 of each year, or upon first doing business with the City. Annual renewals shall be due on or before thirty (30) days after the expiration date of the previous year's license. All license taxes shall be paid in lawful money of the United States at the office of the license collector. The first annual license shall be issued for the unexpired period of such year, except as otherwise specifically provided in this chapter." D. Section 3-1.115. "Taxes: Delinquencies," is hereby amended to read as follows: "A penalty of fifty (50%) percent shall be added to each license tax remaining unpaid thirty (30) days after it becomes due, and, on the first day of each month thereafter that such tax remains unpaid an additional penalty of ten (10%) percent of such unpaid tax shall be added; provided, however, the maximum amount of such penalty shall not exceed an amount equal to the amount of such tax. No penalty fees will be waived under any circumstances." -1- 4`47 E. Section 3-1.118. "Canvassing and soliciting without fixed places of business: Identification certificates," is hereby deleted in its entirety. F. Section 3-1.206. "Auctioneering and auction sales," is hereby amended to read as follows: (a) License Taxes. "The license tax for auctioneering shall be the same as any service business within the City." (b) Permits Required. "No license shall be issued without a permit being first obtained from the City. Application for auctioneering shall be made to the City Manager or his designee. The City Manager, in the exercise of sound and reasonable discretion, may grant or deny such application or revoke or suspend permits already granted." G. Section 3-1.211. "Taxes for businesses with limited City activity," is hereby added to read as follows: "Out -of -City businesses conducting limited business within the City of San Juan Capistrano may request the license collector to pro -rate the business tax based upon the level of activity being conducted in the City as evidenced by an audited financial statement of gross receipts. Such statement shall show the total gross receipts for the previous year as compared to the gross receipts received, or expected to be received from doing business in San Juan Capistrano for the current year. This pro- ration does not apply to the processing/ renewal fee. The minimum tax apportionment from any pro -ration shall be five ($5.00) dollars." H. Section 3-1.212. "Processing/renewal fees," is hereby added to read as follows: "All new businesses shall pay a processing fee in addition to the business tax to cover the administrative costs of processing the application. All businesses renewing their business license shall pay a renewal fee. These fees shall be: $40.00 New Businesses $10.00 Renewals" SECTION 2. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the -2- same to be published and posted as required bylaw. PASSED, APPROVED, AND ADOPTED this Of- March ,1987.
