Ordinance Number 591ORDINANCE NO. 591 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ADDING SECTION 9-3.627 TO TITLE 9 OF THE MUNICIPAL CODE CREATING MINIMUM PROPERTY MAINTENANCE STANDARDS FOR COMMERCIAL AND INDUSTRIAL BUILDINGS WITHIN THE CITY OF SAN JUAN CAPISTRANO THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Municipal Code Section 9-3.627 entitled "Minimum Property Maintenance Standards" is hereby added to Title 9 "Land Use", Chapter 3 "Zoning", Article 6 "Supplementary District Regulations", to read as follows: "Section 9-3.627. Minimum Property Maintenance Standards "(a) Purpose and Intent. "The establishment of minimum property maintenance standards is designed to promote the proper maintenance of commercial and industrial properties located adjacent to those major scenic highways within the City as designated by the City's General Plan. Minimum property maintenance standards will promote appropriate preventative maintenance such that commercial and industrial properties would not create hazardous conditions threatening the public health, safety, or general welfare of the community, or create visual blight upon the community. "(b) Properties Affected. "Commercial and industrial properties to be subject to the application of minimum property standards are those located within or about major scenic highways as designated in Exhibit A attached. "(c) Minimum Property Maintenance Standards "It shall be unlawful for any owner of property located within those areas described in subsection (b) to fail to maintain his/her property to the minimum levels of maintenance care as set forth below: "(i) Landscaping. "All landscaping shall be maintained in a healthy condition free of dead, decayed, overgrown, or discarded plant material. The type and location of landscape material shall be maintained -1- 431 "(iv) "(v) "(vii) SECTION 2. consistent with any approved landscaping plans approved with any land use entitlement received by the property owner; Landscape Irrigation. "Landscape irrigation pipes and sprinkler heads shall be maintained in good working order so as to cover all landscaped area; Tree Trimming. "Trimming of all trees shall be performed in a manner consistent with Municipal Code Seciton 9-3.625(d); Walls. Fences and Other Structures. "All walls, fences and trash exclosures shall be maintained free of significant surface cracks, dry rot, warping; missing panels or blocks which threaten the structure's structural integrity or appearance; Parking Lot and Related Surfaces. "Parking lot surfaces and maintained in a safe condition or other driving or walking buckled or cracked surfaces, o Building Elevations. r pedestrian walkways shall be such that any concrete, asphalt, surfaces are free of potholes, raised areas; "Exterior building elevations shall be maintained in a safe appearance such that the buildings are free of broken, missing or significantly cracked surface finished materials; Trash and Debris. "The property shall be maintained free of the accumulation of trash and debris. Trash and debris associated with the permitted uses are to be stored solely in designated trash enclosures." Municipal Code Section 9-3.625(c) entitled "Severe Tree Trimming Prohibited", of Title 9 "Land Use", Chapter 3 "Zoning", Article 6 "Supplementary District Regulations", is hereby amended to read as follows: "Section 9-3.625(c). Severe Tree Trimming Prohibited. "No property owner or his agent, in the tourist/commercial (CT), general/commercial (CG), commercial/manufacturing (CM), industrial park (MP), planned community (PC), planned development (PD), public and institutional (IP), or design overlay (D) district, or any residential zoning district located within 500 feet of a scenic highway or drive, (as defined by the scenic highways element of the General Plan) or specific stands of trees which may be visible from a scenic highway (as shown on a map -2- 432 located in the office of the City Clerk and the Department of Community Planning and Development and identified as Exhibit C, Section 9-3.625) shall cause any tree on his property to be severely trimmed. "It is unlawful for any property owner who has severely trimmed trees to not allow the trees to regain their prior existing appearance or natural shape." passage. SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
