MORATORIUM ON MINI -MARKET APPROVALS IN THE CITY
AN INTERIM ORDINANCE OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, ESTABLISHING A
MORATORIUM ON MINI -MARKET APPROVALS WITHIN
THE CITY
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
HEREBY ORDAINS AS FOLLOWS:
SECTION 1. Intent.
The City Council finds and determines that certain
properties within the City are presently developed with service
stations. A number of these properties are proposing to convert
to mini -markets. The City has no regulations or development
standards for combination mini -markets and service stations. Due
to the close proximity of existing service stations and their
locations within the City, there could be significant traffic
impacts if all service stations converted to mini -markets. It is
appropriate that a zoning study be undertaken to develop
regulations and standards to minimize impacts of such conversions
and developments.
SECTION 2. Moratorium on Mini -Market Approvals.
Pursuant to the finding set forth above, the City
Council hereby imposes a moratorium on the processing of any
mini -market approvals within the City during the period of the
zoning study. This moratorium shall not be applied to any parcel
which has received approval to develop a mini -market prior to the
effective date of this ordinance.
SECTION 3. Findings.
The City Council hereby finds that there is a current
and immediate threat to the public health, safety and welfare and
that the approval of any additional mini -markets would result in
a threat to the public health, safety and welfare.
This interim Ordinance shall be effective on the date
of its adoption pursuant to Government Code Section 65858 and
shall be of no further force and effect 45 days from the date of
its adoption.

The City Clerk shall certify to the adoption of this
Ordinance and cause the same to be published once as required by
law and posted at the duly designated posting places within the
City of San Juan Capistrano within fifteen (15) days after its
passage.
SECTION 4. City Clerk's -Certification.
PASSED APPROVED AND ADOPTED this 17th day of
June 1966.
