ESTABLISHING MORATORIUM ON SUBDIVISION
ZONED (ES). SMALL ESTATE (VIA PASTORAL
AN INTERIM ORDINANCE OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, ESTABLISHING A
MORATORIUM ON SUBDIVISION MAP APPROVALS FOR
A CERTAIN DESIGNATED AREA ZONED (ES), SMALL
ESTATE (VIA PASTORAL)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
HEREBY ORDAINS AS FOLLOWS:
SECTION 1. Intent.
The City Council finds and determines that a certain
land area zoned as small estate (ES), more specifically depicted
on the attached site plan, marked Exhibit "A" and incorporated
herein by reference, is in need of sewage and traffic circulation
improvements. It is appropriate that a zoning study be
undertaken to develop ameliorative zoning measures to mitigate
the traffic circulation and sewage problems which exist in the
area.
SECTION 2. Moratorium on Subdivision Approvals.
Pursuant to the finding set forth above, the City
Council hereby imposes a moratorium on the processing of any
subdivision approval in the area described in Exhibit "A" during
the period of the zoning study. This moratorium shall not be
applied to any parcel which has received subdivision map approval
prior to the effective date of this Ordinance.
SECTION 3. Findings.
The City Council hereby finds that there is a current
and immediate threat to the public health, safety and welfare and
that the approval of any additional subdivision maps would result
in a threat to the public health, safety and welfare.
This Interim Ordinance shall be effective on the date
of its adoption pursuant to Government Code Section 65858 and
shall be of no further force and effect 45 days from the date of
its adoption.

SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause the same to be published once as required by
law and posted at the duly designated posting places within the
City of San Juan Capistrano within fifteen (15) days after its
passage.
