AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, EXTENDING ORDINANCE NO. 538
PROHIBITING SEVERE TREE TRIMMING PURSUANT TO
GOVERNMENT CODE SECTION 65858 (URGENCY)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO HEREBY
ORDAINS AS FOLLOWS:
SECTION 1.

On May 7, 1985, the City Council enacted interim
Ordinance No. 538 establishing interim regulations governing
severe tree trimming in the City of San Juan Capistrano.
The Community Planning and Development Department has
reported to the City Council that additional time is needed to
study the possibility of permanent regulations governing severe
tree trimming. The City Council hereby finds that there is a
current and immediate threat to the public health, safety and
welfare of the community should there be no zoning regulations
governing severe tree trimming without appropriate zoning
authorization and therefore there would be a threat to the public
health, safety and welfare without the enactment of permanent
zoning regulations for this purpose. The City Council therefore
finds that it is essential that Ordinance No. 538 be extended for
a period of 10 months and 15 days to enable the City to develop
permanent regulations governing severe tree trimming.
SECTION 2.
Based upon the foregoing findings set forth in Section
1 of this Ordinance, the City Council hereby extends Ordinance
No. 538 for the period of 10 months and 15 days.
SECTION 3. Effective Date.
This urgency Ordinance is enacted pursuant to
Government Code Section 65858 and shall take effect and be in
full force immediately.

140 SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause the same to be published once as required by
law and posted at the duly designated posting places within the
City of San Juan Capistrano within fifteen (15) days after its
passage.
