AMENDMENT TO TITLE 4 OF THE MUNICEPAL CODE - OVERLOAD PERMITS
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING OVERLOAD VEHICLE PERMIT
REQUIREMENTS SET FORTH IN ARTICLE 9 OF TITLE 4 "PUBLIC
SAFETY" OF THE MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Amendments.
a. Municipal Code Section 4-6.905 is hereby amended in its entirety to read
as follows:
'Section 4-6.905. Overload Permit Requirements.
The application for an overload permit shall be made on the standard
transportation permit application required by the California Department of
Transportation pursuant to Vehicle Code Section 35781. All information required by the
form shall be filled out completely before it shall be processed by the City Engineer.
The permit application and fees requirements are effective as of July 1, 1990.
b. Section 4-6.907 is amended in its entirety to read as follows:
Section 4-6.907 Permit Fees.
A permit issuance fee shall be paid by the applicant upon the filing of
each application for an overload permit. Special services necessitated by unusual or
extraordinary conditions requiring engineering, investigation, or the social services shall
be billed separately for each permit.
C. Pursuant to Vehicle Code Section 35795(b), the City Council shall set the
fee by adopting a resolution adopted after notice and hearing. Notice of hearing shall be
by publication as provided in Government Code Section 6064.

SECTION 2. Repealer.
Municipal Code Section 4-6.909 is hereby repealed in its entirety.
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its

SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be published once as required by law and posted at the duly designated posting
places within the City of San Juan Capistrano within fifteen (15) days after its passage.
