Ordinance Number 667ORDINANCE NO. 667 MORA' AN URGENCY ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, EXTENDING URGENCY ORDINANCE NO. 664 IMPOSING A MORATORIUM ON THE PROCESSING OF DEVELOPMENT APPLICATIONS FOR PROPERTY WITHIN THE ALIPAZ EXTENSION STUDY AREA IN ACCORDANCE WITH SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. On May 15, 1990, the City Council adopted Urgency Ordinance No. 664, imposing a moratorium on the processing of development applications for property within the Alipaz Extension study area as identified in said ordinance. . The City Council finds and determines that it is necessary to extend said urgency ordinance for a period of 10 months and 15 days, that is, to and including May 4, 1991, on the basis that present general plan use designations are predicated on future construction of the Alipaz Extension. Deletion or down -grading of the extension would decrease overall access and traffic capacity to serve new development, and therefore, might require a reduction in General Plan land use intensities for affected property in order to insure protection of the environment and public health and safety. Accordingly, there is a current and immediate threat to the public health, safety and welfare in that approval of additional land use entitlements such as subdivisions, use permits, variances, building permits, or other zoning entitlements would result in a threat to public health, safety and welfare in view of the above -stated findings. SECTION 2. Extension of Urgency Ordinance No. 664. Based upon the foregoing findings, Urgency Orinance No. 664 is hereby extended to May 4, 1991. SECTION 3. Effective Date. This Urgency Ordinance shall take effect immediately upon its adoption. -1- SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
