AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP ADOPTED
BY ORDINANCE NO. 293 BY CHANGING THE ZONING OF
ASSESSOR'S PARCELS 649-011-25 AND 649-011-30 FROM
PLANNED COMMUNITY (COMPREHENSIVE DEVELOPMENT PLAN
75-1) TO PLANNED COMMUNITY (COMPREHENSIVE
DEVELOPMENT PLAN 89-1) (ENTERPRISE CONSTRUCTION,
INC./PUEBLO SERRA)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
The application is consistent with the goals, policies, and objectives of
the General Plan.
2. The development of the property under.the new zoning will conform to
the standards contained in the City's Land Use Code.
3. A public hearing describing the purpose of the zone change and the time,
date, and location of the hearing was published in the Capistrano Valley
News. Property owners within 300 feet of the project boundary were
sent notice of the project pursuant to requirements of state law.
4. An environmental impact report was prepared for the proposed project,
which report has been certified as complete by the City Council. All
requirements of the California Environmental Quality Act have been
met.
SECTION 2. Zone Change.
Based on the findings set forth in Section 1, preceding, the City Council
ordains that the official zoning heretofore adopted for Assessor Parcels 649-011-25 and
649-011-30 be changed from Planned Community (Comprehensive Development Plan 75-
1) to Planned Community (Comprehensive Development Plan 89-1). Said zone change is
designated herein as Rezone 89-1.
The new zoning shall also incorporate that certain document on file at the City
offices entitled "Comprehensive Development Plan 89-1, Adopted August, 1989" which
shall comprise the text/graphics portion of the new PC zoning. Said Comprehensive
Development Plan is hereby adopted by reference as part of RZ 89-1 as if fully set forth
herein.
The land area contained within RZ 89-1 is specifically depicted on "Exhibit A",
attached hereto.
SECTION 3. Effective Date.

This Ordinance shall take effect and be in force thirty (30) days after its

SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be published once as required by law and posted at the duly designated posting
places within the City of San Juan Capistrano within fifteen (15) days after its passage.
