ORDINANCE NO. 643
APPROVING REZONE 88-3 (SAN JUAN CHRYSLER/ALEX)
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP ADOPTED
BY ORDINANCE NO. 293 BY CHANGING THE ZONING OF
ASSESSOR'S PARCEL NOS. 661-301-06 AND -07 FROM GM
(GROWTH MANAGEMENT) TO CM (COMMERCIAL
MANUFACTURING) (SAN JUAN CHRYSLER/ALEX)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
1. The proposed zoning is consistent with all elements of the General Plan
and General Plan Amendment 88-3 (San Juan Chrysler/Alex).
2. The development of the property under the proposed zoning will conform
to the development standards and other applicable provisions of the
Municipal Code, Architectural Control 88-1 (San Juan Chrysler/Alex) and
Zone Variance 88-5 (San Juan Chrysler/Alex).
3. A public hearing notice denoting the purpose of the request, time, date,
and location of the hearing was published in the Capistrano Valley
News. Property owners within 300 feet of the project boundary were
sent notice of the project pursuant to State law requirements.
4. The City's Environmental Review Board determined that this project will
not have a significant impact on the environment and issued a Negative
Declaration which has been certified by the City Council, and has
otherwise carried out all the requirements of the California
Environmental Quality Act. A supplemental traffic study has been
prepared.
5. The City'sg Planning Commission has reviewed this item and forwarded it
to the City Council with a recommendation of denial.
SECTION 2. Zone Change.
Based upon the findings set forth in Section 1, preceding, the City Council
ordains that the official zoning heretofore adopted for Assessor's Parcel Nos. 661-301-06
and -07 be changed from (GM) Growth Management) to CM (Commercial
Manufacturing). Said zone change is designated herein as Rezone 88-3 and is more
specifically depicted in Exhibit A attached hereto.
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its
passage.

SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be posted at the duly designated posting places within the City and published
once within fifteen (15) days after passage and adoption is required by law; or, in the
alternative, the City Clerk may cause to be published a summary of this Ordinance and a
certified copy of the text of this Ordinance shall be posted in the Office of the City
Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen
(15) days after adoption, the City Clerk shall cause to be published, the aforementioned
summary and shall post a certified copy of this Ordinance, together with the vote for and
against the same, in the Office of the City Clerk.
