ORDINANCE NO. 624
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING SECTION 9-3.607(eX2) OF THE
MUNICIPAL CODE RELATING TO GRADING FOR TENNIS COURT
DEVELOPMENT
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:

SECTION 1. Findings.
The City Council finds that:
A. The City's Environmental Review Board has reviewed the proposed
amendment and determined that the project is a minor change in land use
regulations and therefore categorically exempt from further
environmental review.
B. This amendment will provide development standards for tennis courts in
hillside areas that minimizes the visual impacts and may streamline the
review process.
C. A duly noticed public hearing has been held to receive and consider
public testimony regarding the proposed amendment.
SECTION 2.
Amendment Text.
A. Introduction.
Based upon the findings set forth in Section 1, preceding, the following
amendment to the Municipal Code set forth under paragraph B,
following, is hereby enacted.
B. Amendment.
I. Section 9-3.607(eX2) is hereby amended to read as follows:
"(2) Grading. The total depth of fill area shall not exceed
four (4') feet in height. The use of retaining walls to
support this fill is prohibited. The total depth of cut
area shall not exceed 12 feet in height provided the
cut slope or retaining wall is not visible from adjoining
properties. Tennis courts on sites containing natural
slopes in excess of 25 percent shall be prohibited."
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its

The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be published once as required by law and posted at the duly designated posting
places within the City of San Juan Capistrano within fifteen (15) days after its passage.
