Ordinance Number 606ORDINANCE NO. 606 AMENDMENT TO TITLE 5 OF THE MUNICIPAL CODE - USE OF PUBLIC PARKS AND FACILITIES AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ADDING CHAPTER 23 ENTITLED "USE OF PUBLIC PARKS AND FACILITIES," TO TITLE 5, "PUBLIC WELFARE," OF THE MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Code Amendment. Chapter 21, entitled "Use of Public Parks and Facilities," is hereby added to Title 5, "Public Welfare," of the Municipal Code to read as follows: "CHAPTER USE OF PUBLIC PARKS AND FACILITIES "Section 5-21.01. Golf Prohibited in Public Parks "No person shall use any portion of any City park or City -owned property for golfing purposes, or make use of any golf club or golf ball in any City park or on City - owned property. "Section 5-21.02. Operation of Vehicles on Public Park Property Prohibited. "a. No person shall drive or ride, at any time, any auto, truck, motorcycle, motor scooter, or other motor vehicle upon City park or playground, except on public streets running through such premises or within designated parking areas located upon the premises, without the express written consent of the director of the Department of Community Services. "'b. Parking of vehicles upon public park areas is prohibited except within specially -designated parking areas. "c. Where the operation of vehicles is permitted within public park areas, a maximum speed of five (5) miles per hour shall be in effect at all times. "'d. Horses shall be allowed only on specific bridle paths or in designated parks with appropriate equestrian amenities. "Section 5-21,03. Adherence to Park Restrictions as Designated on Signing. The Director of Community Services may place and maintain, or cause to be placed and maintained, such signs, notices, signals or control devices as he deems necessary to ensure public safety and orderly and efficient use of any park or playground. Any person using these areas shall obey any sign, notice, signal, or other control device placed or erected pursuant to this Section. -1- 74 "Section 5-21.04. Destruction of City Property. "Any person, other than a duly -authorized City employee in the performance of his duties, shall not: "a. Dig, remove, destroy, injure, mutilate, or cut any tree, plant, shrub, grass, or flower, or any portion thereof, growing in the parks; "b. Remove any wood, turf, grass, soil, rock, sand, or gravel from any park; "c. Cut, break, injure, deface, or disturb any rock, building, cage, pen, monument, sign fence, bench, structure, apparatus equipment, or property in any park, or any portion thereof; or mark or place thereon or on any portion thereof, any mark, writing or printing, or attach thereto any sign, card display, or any similar device. "Section 5-21.05. Recreational Facilities Permit Required. "Any person not having a permit for the use of a recreational facility, using any recreational facility of any park or school district property where so designated for scheduling by the Community Services Department of the City of San Juan Capistrano, shall surrender or turn over possession of said recreational facility to any person having possession of a permit from the Community Services Department for the use of said facility. "It shall be unlawful for any person not having a permit from the Communitiy Services Department to refuse or fail to surrender the use of any recreational facility to any person who has a permit for the use of said facility from the Community Services Department of the City of San Juan Capistrano." passage. SECTION 2. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its SECTION 3. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
