ORDINANCE NO. 729
APPROVING REZONE 93-2 - CALTRANS PARK AND RIDE
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, APPROVING REZONE 93-2, WHICH AMENDS THE
OFFICIAL ZONING MAP OF THE CITY FOR A 0.60-ACRE PARCE-
LOCATED AT THE NORTHWEST CORNER OF JUNIPERO SERRA
AND RANCHO VIEJO ROADS FROM GROWTH MANAGEMENT
(GM) TO PUBLIC INSTITUTIONAL UP) (CALTRANS PARK AND
RIDE)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
A. The applicant, Caltrans, 15500 Rockfield Avenue, Suite B, Irvine,
California 92718, has requested approval of a rezone, Rezone 93-2, for the northwest
corner of the intersection of Junipero Serra and Rancho Viejo Roads.
B. The City has determined, pursuant to the provisions of the California
Environmental Quality Act (1970), that this project is categorically exempt (Class 3), and
has otherwise carried out ail applicable provisions of that Act.
C. The Rezone Ordinance is consistent with the goals, policies and
objectives of the San Juan Capistrano General Plan in that the project site is designated
General Open Space on the General Plan Map, which is consistent with the Public
Institutional District (IP) according to the Consistency Matrix of the Municipal Code.
D. The Planning Commission conducted a public hearing on March 23, 1993,
and recommended that the City Council adopt the Ordinance.
E. The proposal, Rezone 93-2, complies with all applicable provisions of
Title 9 of the Municipal Code, subject to mitigation measures and conditions cited by this
Ordinance.
SECTION 2. Amendment.
Based upon the findings set forth in Section 1, preceding, the Official Zoning
Map of the City of San Juan Capistrano is hereby amended to change the zoning of that
0.60-acre portion of Caltrans right-of-way situated at 26685 Junipero Serra Road from
Growth Management (GM) to Public Institutional (IP) for the purpose of developing a
Park and Ride facility as depicted on Exhibit "A", attached hereto and made a part
hereof.
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its
passage.

SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be posted at the duly designated posting places within the City and published
once within fifteen (15) days after passage and adoption as required by law; or, in the
alternative, the City Clerk may cause to be published a summary of this Ordinance and a
certified copy of the text of this Ordinance shall be posted in the Office of the City
Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen
(15) days after adoption, the City Clerk shall cause to be published, the aforementioned
summary and shall post a certified copy of this Ordinance, together with the vote for and
against the same, in the Office of the City Clerk.
