AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING TITLE 9, CHAPTER 2, SECTION 9-2.312
OF THE MUNICIPAL CODE TO MODIFY THE ADMINISTRATIVE
APPROVAL PROCESS FOR TEMPORARY USE PERMITS, AND
AMENDING TITLE 9, CHAPTER 3, SECTIONS 9-3.304 AND 9-3.608
TO DELETE RELIGIOUS, FRATERNAL AND SERVICE
ORGANIZATIONS AS TEMPORARY USES AND ADD AS
CONDITIONAL USES
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
A. In October, 1992, the City Council initiated an amendment to Title 9 of
the Municipal Code to modify the approval process for temporary use permits.
B. The proposed action has been determined to be categorically exempt
from California Environmental Quality Act Guidelines under Class 5, Minor alternations
in land use limitations.
C. A public hearing was duly advertised and held by the Planning
Commission on December 8, 1992, and January 12, 1993, to review public testimony on
the action.
D. A public hearing was duly advertised and held by the City Council on
February 2, 1993, to review public testimony on the action.
SECTION 2. Amendments.
(1) Section 9-2.312(b)(4) of the Municipal Code is hereby amended to read as
follows:
"(4) The Director may classify uses and structures not specified by Section
9-3.608 as temporary uses based upon findings that such uses will not
exceed one year, will be compatible with the adjoining properties, will be
consistent with the General Plan and are inherently temporary without
the potential to become permanent."
(2) Sections 9-3.608(d) and.(*) of the Municipal Code are hereby deleted in
their entirety.
(3) Section 9-3.304 is hereby amended by adding the following new
subsection:

"(j) Religious, fraternal, or service organizations (non-profit). Such Uses
include churches, temples, synagogues, monasteries, religious retreats,
and other places of religious worship and other fraternal and community
service organizations."
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its
passage.

SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be published once as required by law and posted at the duly designated posting
places within the City of San Juan Capistrano within fifteen (15) days after its passage.
