ORDINANCE NO. 773
AMENDING TITLE 5. CHAPTER 24 OF THE MUNICIPAL CODE -
REGULATION OF MASSAGE LICENSING (URGENCY
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
AMENDING TITLE 5, CHAPTER 24 OF THE SAN JUAN CAPISTRANO
MUNICIPAL CODE RELATING TO MASSAGE LICENSING (URGENCY)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
An urgency ordinance pursuant to Government Code Section 36937(b) for the
immediate preservation of the public peace, health or safety, upon a four-fifths vote of the approval
by the City Council, based upon the following findings of fact:

SECTION 2. Amendments.
Based on the findings in Section 1 preceding, Title 5, Chapter 24 of the San Juan
Capistrano Municipal Code is hereby amended by adding Sections 5-24.02 and 4-24.03 thereto to
read as follows:
"Section 5-24.02. Specific License Requirements.
"Every person applying for this license must have had at least five (5) years' experience
in the profession, work and method of treating the external parts of the human body for remedial or
hygienic purposes by rubbing, stroking, kneading, adjusting or tapping with the hand or hands or by
instrument, or must have graduated from a recognized school of massage or other institution of
learning wherein the method, profession and work of massaging is taught.
"Section 5-24.03. Regulations; Immoral Practices Prohibited.
"It shall be unlawful for any person employed as a massagist or in a massage parlor
or public bath to massage any other person or give or administer any bath or baths or to give or
administer any of the other things mentioned in this article for immoral purposes or in a manner
intended to arouse, appeal to or gratify the lust or passions or sexual desires."

SECTION 3. Effective Date.
This Ordinance shall take effect immediately upon passage.
SECTION X. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the same to
be published once as required by law and posted at the duly designated posting places within the City
of San Juan Capistrano within fifteen (15) days after its passage.
