Ordinance Number 765ORDINANCE NO. 765 1 1L M A 11 L AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING TITLE 9, SECTION 9-3.603 OF THE MUNICIPAL CODE ESTABLISHING CRITERIA FOR CONSIDERATION OF COMMUNITY -WIDE EVENT BANNERS WITHIN THE PUBLIC RIGHT-OF-WAY THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findinas. 1. Title 9 of the Municipal Code does not include criteria for consideration of community -wide event street banner requests for events other than those sponsored or co-sponsored by the City. 2. The City has issued a Class 5 categorical exemption pursuant to the provisions of the California Environmental Quality Act (1970) and otherwise carried out all applicable provisions of that Act. 3. This Ordinance is consistent with the goals, policies, and objectives of the San Juan Capistrano General Plan. 4. The Planning Commission conducted a public hearing on the project and recommended that the City Council adopt the Ordinance. SECTION 2. Amendment Text. Based upon the findings set forth in Section 1 preceding, the following amendment to the Municipal Code is hereby enacted: Section 9-3.603(f)(15) shall be amended in its entirety to read as follows: "Section 9-3.603(f)(15). Community -wide special events. The Planning Director may approve banners within the public right-of-way for community -wide events provided the street banner request meets all of the following criteria: (aa) The event must be open to the general public. (ab) The event must be held within the City limits. -1- (ac) Authorized City -conducted events shall include, but not be limited to, the community fair, Fiesta de las Golondrinas, Fourth of July celebration, Shop San Juan, and the carnival(s). Other authorized events must either be sponsored or endorsed by a public agency, non-profit, fraternal, or service organization; or directly benefits a charitable organization within the community. (ad) The event must generate an estimated attendance for the duration of the activity of at least 1,000 individuals. The City Council may waive this requirement if the overall intent of allowing street banners for community -wide events is satisfied. (ae) Processing of all street banner requests shall be in accordance with the specifications, regulations and procedures set forth in City Council Policy No. 419." SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
