Ordinance Number 757181 ORDINANCE NO. 757 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING PRIMA FACIE SPEED LIMITS AT VARIOUS LOCATIONS BY AMENDING TITLE 4, CHAPTER 6, ARTICLE 5, SECTION 4-6.501 OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE WHEREAS, California Vehicle Code Section 22357 allows local entities to increase prima facie speeds of 25 miles per hour (as defined by the California Vehicle Code as residential or business districts) to between 30 miles per hour and 50 miles per hour, Section 22358 allows local authorities to decrease prima facie speeds of 55 miles per hour (for all roads not defined by the California Vehicle Code as, residential or business districts) to between 50 miles per hour and 30 miles per hour and Section 22358.3 allows local entities to decrease prima facie speeds of 25 miles per hour (as defined by the California Vehicle Code as residential or business districts) because of narrow roadway width to 20 miles per hour or 15 miles per hour; and, WHEREAS, California Vehicle Code Section 627 defines an Engineering and Traffic Survey to include a consideration of all of the following: 1. Prevailing speeds as determined by traffic engineering measurements; 2. Accident records; 3. Highway, traffic and roadside conditions not readily apparent to the driver; and, WHEREAS, the City of San Juan Capistrano has completed an Engineering and Traffic Survey pursuant to California Vehicle Code Section 22357, 22358 and 22358.3. THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Title 4, Chapter 6, Article 5 of the San Juan Capistrano Municipal Code is hereby amended in its entirety to read as follows: "Article 5. Speed Limits -I- 182 "Section 4-6.5iJI. Established. Pursuant to the provisions of Sections 22357, 22358 and 22358.3 of the California Vehicle Code, prima facie speed limits in the City of San Juan Capistrano are hereby determined and declared as follows: "(a) Fifteen miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be fifteen (15) miles per hour: "(1) Los Rios Street from Verdugo Street to Mission Street. "(b) Twenty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be twenty (20) miles per hour: "(1) Los Rios Street from Del Obispo Street to Verdugo Street. "(c) Twenty-five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be twenty-five (25) miles per hour: "(1) Alipaz Street from its southerly end to Camino Del Avion; "(2) Alipaz Street from Del Obispo Street to its northerly end; "(3) Avenida de la Vista from southerly end to Oso Road; "(4) Calle Arroyo from La Novia Avenue to Avenida Siega; "(5) Camino Capistrano from Del Obispo Street to Ortega Highway; "(6) El Camino Real from Forster Street to La Zanja Street: "(7) La Zanja Street from Avenida de la Vista to Camino Capistrano; "(8) Mission Hills Drive from Rancho Viejo Road to its easterly end; "(9) Ortega Highway from I-5 to Camino Capistrano. "Note: Ortega Highway (from I-5 to the easterly City limits) speed limit surveys are provided, as needed, to the State for their consideration in determining the speed limits they set on this State Highway. "(10) Via de Agua from Camino Las Ramblas to Calle Delgado; "(11) Village Road from Rancho Viejo Road to Trabuco Creek Road. -2- tss "(d) Thirty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be thirty (30) miles per hour: "(1) Aguacate Road from Del Obispo Street to Aguacate Lane; "(2) Avenida Aeropuerto from Camino Capistrano to its westerly end; "(3) Calle Arroyo from its westerly end to Rancho Viejo Road; "(4) Calle Aspero from Del Obispo Street to Peppertree Bend; "(5) Camino La Ronda from La Novia Avenue to its easterly end; "(6) Highland Drive from Rancho Viejo Road to Hillside Terrace; "(7) Valle Road from 1-5 northbound ramps to San Juan Creek Road. "(e) Thirty-five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be thirty-five (35) miles per hour; "(1) Calle Arroyo from Rancho Viejo Road to La Novia Avenue; "(2) Camino Capistrano from San Juan Creek Road to Del Obispo Street; "(3) Camino Capistrano from Ortega Highway to La Zanja Street; "(4) Del Obispo Street from Calle Aspero to Ortega Highway; "(5) Junipero Serra Road from Camino Capistrano to Rancho Viejo Road; "(6) La Novia Avenue from Ortega Highway to Via Capri (westerly connection); "(7) Rancho Viejo Road from Calle Arroyo to Ortega Highway; "(8) San Juan Creek Road from La Novia Avenue to its easterly terminus; "(9) Trabuco Creek from Rancho Viejo Road to its easterly end; "(10) Valle Road from its southerly end to I-5 northbound ramps. -3- "(f) Forty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be forth (40) miles per hour: "(1) Alipaz Street from Camino del Avion to Del Obispo Street; "(2) Camino Capistrano from Doheny Park Road to Stonehill Drive; "(3) Camino Capistrano from La Zanja Street to Junipero Serra Road; "(4) Camino del Avion from the westerly City limits to Alipaz Street; "(5) Del Obispo Street from Camino Del Avion to Calle Aspero; "(6) Camino Las Ramblas from the southerly City limits (I-5) to Kinkerry Lane; "(7) La Novia Avenue from Via Capri (westerly connection) to Valle Road; "(8) Rancho Viejo Road from Junipero Serra Road to the northerly City limits. "(g) Forty-five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be forth -five (45) miles per hour: "(1) Camino Capistrano from Stonehill Drive to San Juan Creek Road and from Junipero Serra Road to the northerly City limits; "(2) Del Obispo Street from the southerly City limits to Camino del Avion; "(3) Doheny Park Road from the southerly City limits to Camino Capistrano; "(4) Rancho Viejo Road from Ortega Highway to Junipero Serra Road; "(5) San Juan Creek Road from Camino Capistrano to La Novia Avenue. "(h) Fifty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be fifty (50) miles per hour: "(1) Stonehill Drive from the westerly City limits to Camino Capistrano." -4- The Legislative findings in support of prima facie speed limits previously set forth by the City Council in Ordnance No. 520, adopted on October 16, 1984, Ordinance No. 588, adopted on December 16, 1987, Ordinance No. 621, adopted on January 19, 1988, Ordinance No. 659, adopted on February 20, 1990, Ordinance No. 661, adopted on April 3, 1990, Ordinance No. 680, adopted on December 11, 1990, and Ordinance No. 727, adopted on March 16, 1993, shall continue to remain in effect unless amended herein. This Ordinance shall take effect and be in force thirty (30) days after its passage. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk.
