Ordinance Number 744065 ORDINANCE NO. 744 APPROVING REZONE 935 - AMENDING SPECIFIC DEVELOPMENT PLAN 87-1 (PRICE CLUB) AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING REZONE 93-5, AMENDING SPECIFIC DEVELOPMENT PLAN 87-1 TO PERMIT THE ESTABLISHMENT OF VEHICLE RENTAL AGENCIES WITHIN THE PRICE CLUB CENTER AND CHANGING THE SHOPPING CENTER'S PARKING RATIO FROM ONE STALL PER 200 SQUARE FEET OF LEASABLE FLOOR AREA TO ONE STALL PER 250 SQUARE FEET OF LEASABLE FLOOR AREA (PRICE CLUB) THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds that: 1. The proposed rezone is consistent with the goals, policies and objectives of the General Plan in that the Land Use Element of the General Plan states that the priority of commercial development should be directed toward those uses which maximize revenues, minimize required services and do not add to population growth pressures. 2. The development of the property under the amended Specific Development Plan will conform to the standards contained in the City's Land Use Code. 3. The City s Environmental Review Board has reviewed this project and determined that it qualities for the issuance of a mitigated negative declaration. SECTION 2 Amendment Text. Based upon the findings set forth in Section 1, preceding, the City Council ordains that Specific Development Plan 87-1 is amended as follows: 1. Section XI (17)(3) (Prohibited Uses) of Specific Development Plan 87-1 is amended, deleting vehicle rental agencies from the list of prohibited uses at the Price Club Center. 2. Section XI (17)(4)(H) (Site Development Standards, Off-site Parking) of Spec Development Plan 87-1 is amended to read as follows: a. Off -Street Parking - Off-street parking shall be provided in compliance with Section 9-3.602 (Off-street parking and loading) of the San Juan Capistrano Municipal Code with the exception of the off-street parking requirements: schedule (3)(ii). Instead the following shall apply: For general retail and office uses one (1) off-street parking space per each 250 square feet of leasable floor area shall be required. SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. -1- t.. SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
