Ordinance Number 738021 ORDINANCE NO. 738 AMENDING TITLE 2 OF THE MUNICIPAL CODE - APPOINTMENTS DUTIES AND RESPONSIBILITIES OF COMMISSIONS AND BOARDS AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING TITLE 2 (ADMINISTRATION), CHAPTER 2 (COMMISSIONS AND BOARDS) OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE - APPOINTMENTS, TERMS OF OFFICE, COMMISSION AND BOARD DUTIES AND RESPONSIBILITIES THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Code Amendments. 1. Section 2-2.102 of Article 1 "Membership", of Chapter 2 of Title 2 of the San Juan Capistrano Municipal Code is hereby amended to read as follows: "Section 2-2.102. Terms of Office. Each member of a commission or board shall serve for a one-year term. The terms of such membership shall expire on March 31st of the designated expiration year, notwithstanding the expiration of the term of a commission or board, such member shall continue to serve as such until their successor is appointed and qualified. Each member of a commission or board appointed on November 2, 1993, shall continue to hold office for the term for which they were appointed until March, 1995; provided, however, the provisions of this Chapter are not amended, nor are in conflict with the provisions of this Chapter which shall control and govern such continuance in office." 2. Article 2 'Design Review Commission" of Chapter 2 of Title 2 of the San Juan Capistrano Municipal Code is hereby repealed in its entirety. 3. Article 5 "Equestrian and Recreation Trails Commission, of Chapter 2 of Title 2 of the San Juan Capistrano Municipal Code is hereby amended to read as follows: "Article 5. Parks, Recreation and Equestrian Commission. -1- )22 Section 2-2.501. Created. A Parks, Recreation and Equestrian Commission for the City is hereby created. Section 2-2.502. Membership. The Parks, Recreation and Equestrian Commission shall consist of a total of five (5) members. Section 2-2.503. Duties. The Parks, Recreation and Equestrian Commission shall undertake and have the following duties, responsibilities, and functions, together with the powers incidental thereto: (a) To review and make recommendations to the Planning Commission concerning tentative maps with regard to their relationship to the City's Parks Program and the Equestrian and Recreation Trails Plan as identified in the Parks and Recreation Element of the General Plan of the City; (b) To review and make recommendations to the Planning Commission on capital improvement plans for parks and recreational trails which are developed to implement the Parks and Recreation Element of the City's General Plan. (c) To study and make recommendations to the Planning Commission on proposed amendments to the Parks and Recreation Element of the City's General Plan. (d) To study and make recommendations to the Planning Commission on proposed design standards for private and public recreational facilities including parks, bicycle, hiking and equestrian trails, and equestrian facilities for the boarding, training and raising of horses. (e) To undertake such other duties as may be assigned by the City Council." 4. Article 6 'Parks and Recreation Commission", of Chapter 2 of Title 2 of the San Juan Capistrano Municipal Code is hereby repealed in its entirety. -2- 023 5. Article 7 "Planning Commission", of Chapter 2 of Title 2 of the San Juan Capistrano Municipal Code is hereby amended in its entirety to read as follows: "Article 7. Planning Commission. Section 2-2.701. Created. A Planning Commission for the City is hereby created. Section 2-2.702. Membership. The Planning Commission shall consist of a total of seven (7) members. Section 2-2.703. Duties. The Planning Commission shall undertake and have the following duties, responsibilities, and functions, together with the powers incidental thereto: (a) To study and make recommendations to the City Council on amendments to the City's General Plan. (b) To develop and make recommendations to the City Council on specific plans designed to implement portions of the City's General Plan. (c) To review the City's Capital Improvement Program for consistency with the City's General Plan and forward recommendations to the City Council. (d) To make recommendations to the City Council to effectuate changes to the land use provisions set forth in Title 9 of this Code, consistent with the provisions of the General Plan. (e) To approve, deny, or approve with modifications or conditions, development proposals, or parts thereof, in accordance with the land use provisions set forth in Title 9 of this Code. (f) To appoint three members of the Planning Commission to serve on the Design Review Committee to review and make recommendations to the Planning Commission on development N 024 proposals processed in accordance with Title 9, Chapter 2, Article 2, Section 9-2.306 of this Code. (g) To,undertake such other duties as may be assigned by the City Council." 6. Article 8 "Traffic and Transportation Commission", of Chapter 2 of Title 2 of the San Juan Capistrano Municipal Code is hereby amended in its entirety to read as follows: "Article 8. Transportation Commission Section 2-2.801. Created. A Transportation Commission for the City is hereby created. Section 2-2.802. Membership. The Transportation Commission shall consist of five (5) members. Section 2-2.803. Duties. The Transportation Commission shall undertake and have the following duties, responsibilities, and functions, together with the powers incidental thereto: (a) To recommend to the Planning Commission amendments to the Circulation Element of the General Plan and associated implementation measures. (b) To study and make recommendations to the Planning Commission on proposed regional and State planning programs that are transportation -related, including proposed regulations that could affect the City. (c) To review and make recommendations to the Planning Commission on major Capital Improvement projects that are designed to implement a multi -modal transportation system. (d) To study and make recommendations to the Planning Commission regarding site development plans and tentative maps with regard to impacts to the City's circulation system. I" passage. (e) To study and make recommendations to the Planning Commission on matters related to public transportation, traffic regulations and standards for parking, vehicular and public safety. (f) To undertake such other duties as may be assigned by the -City Council." SECTION 2. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its SECTION 3. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk.
