Ordinance Number 819301 ORDINANCE N0. 819 APPROVING REZONE 96-5 AND ADOPTING SPECIFIC PLAN 97-1 (RESCO DEVELOPMENT/SHURGARD STORAGE/SCHAUWECKER) AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING REZONE 96-5 AND ADOPTING SPECIFIC PLAN 97-1 FOR A 92,165 -SQUARE -FOOT SELF -STORAGE FACILITY TO BE LOCATED ON A 2.435 -ACRE PARCEL OF LAND AT 32731 SAN JUAN CREEK ROAD (RESCO DEVELOPMENT/SHURGARD STORAGE/ SCHAUWECKER) THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. WHEREAS, the City Council finds that the proposed use is compatible with applicable goals, policies and objectives of the General Plan in that the proposed Precise Plan will permit a self -storage use which is of low intensity and is not noise sensitive to the San Diego Freeway, and will not generate a significant amount of traffic. Furthermore, because architectural design is an integral component of a Precise Plan, the proposed project is consistent with the Community Design Element of the General Plan. WHEREAS, the City Council finds that the current Private Recreation zoning of the property permits numerous recreational uses including miniature golf courses, billiard and pool centers, bowling lanes, private clubs and 'odges and horse stables which will be more intensive in terms of traffic, noise, dust and odors than the proposed self -storage facility. WHEREAS, the City Council finds that the subject property hasa General Plannoise overlay designation due to its proximity to the San Diego Freeway. The noise overlay district permits a mix of zone districts as appropriate, as long as the proposed uses are compatible with adjacent land uses and are not sensitive to noise generated by the freeway. The Precise Plan zoning would permit a self -storage facility which is not sensitive to noise. Also the proposed use will not generate significant negative impacts to adjacent properties due to its limited hours of operation and minimal generation of traffic, light and noise. SECTION 2 Amendment Text Based upon the findings set forth in Section 1, preceding, the City Council ordains that Specific Development Plan 97-01, including site design, architecture and landscaping plans, is adopted as contained in Exhibit A. 302 SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk. Permitted uses shall be limited to a "self storage facility" designed, constructed and operated in a manner consistent with the approval of General Plan Amendment 95-03, Rezone 96-05, and Architectural Control Application 96-09. Office and access hours for the storage facility shall be from 7:00 a.m. to 9:00 p.m.. An employee of the facility shall be on site during this time. The operation of businesses from the "self -storage facility" shall be prohibited. This prohibition is not intended to prevent the storage of business related items at the storage facility. Development standards shall be as established for the "Commercial Manufacturing" (CM) District with the exception of setbacks for the project site which shall be as follows: Location Minimum Required Setback North (sideyard) 15' South (sideyard) 15' East (rearyard) 20' West (frontyard) 30' All other supplementary regulations shall be consistent with Article 6, of Title 9 of the Municipal Code. Amendments to Precise Plan 97-01 Precise Plan 97-01 shall be amended in the same manner as set forth in Section 9-3.410(c) of the Municipal Code.
