APPROVING REZONE 97-9 - WESELOH CHEVROLET/HONDA
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
APPROVING REZONE 97-9 TO CHANGE THE CURRENT ZONING
DESIGNATION ON PROPERTY KNOWN AS ASSESSOR'S PARCEL
NUMBERS 121-240-19, 121-240-74 AND 121-254-41 FROM PLANNED
DEVELOPMENT (PD) TO COMMERCIAL MANUFACTURING (CM) AND
AMENDING THE CITY'S OFFICIAL ZONING MAP TO REFLECT THE
CHANGE (WESELOH CHEVROLET/HONDA - NORTHWEST CORNER OF
CAMINO CAPISTRANO AND STONEHILL DRIVE)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findines.
WHEREAS, the proposed rezone has been processed pursuant to the requirements
of Municipal Code Sections 9-2.301 and 9-2.302; and,
WHEREAS, in the determination of staff, the area to be covered by this amendment
of the City's Official Zoning Map will allow an effective integration of Commercial Manufacturing
(CM) uses; and,
WHEREAS, the Environmental Administrator has reviewed the project pursuant to
Section 15061 of the California Environmental Quality Act and has issued a Categorical Exemption
and caused a Notice of Exemption to be posted pursuant to the City's Environmental Review
Guidelines and has otherwise complied with all applicable provisions of the California
Environmental Quality Act; and,
WHEREAS, the Ordinance is consistent with the goals, policies and objectives of
the San Juan Capistrano General Plan in that the principal, accessory, and conditional uses provided
for within the Commercial Manufacturing District (CM), are consistent with other uses and districts
in the immediate area and will, therefore, facilitate thoughtful development as promoted in the Land
Use Element; and,
WHEREAS, on May 12,1998, the Planning Commission conducted a duly -noticed
public hearing and recommended that the City Council approve the rezone.

SECTION 2. Amended Area.
Upon adoption of this ordinance, the area better known as Assessor's Parcel Numbers
121-240-19,1210-240-74 and 121-254-41 shall be designated a Commercial Manufacturing (CM)
District on the City's Official Zoning Map.
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its passage.
SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the same to
be published once as required by law and posted at the duly designated posting places within the
City of San Juan Capistrano within fifteen (15) days after its passage.
