Ordinance Number 816283 ORDINANCE NO. 816 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING REZONE 97-5 AND ADOPTING PRECISE PLAN 97-6 FOR A 107,358 -SQUARE -FOOT SELF -STORAGE FACILITY TO BE LOCATED AT THE CONFLUENCE OF INTERSTATE 5 AND VALLE ROAD (VALLE ROAD SELF-STORAGEINESS) THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: The City Council finds that: 1. The proposed use is compatible with applicable goals, policies, and objectives of the General Plan in that the proposed Precise Plan will permit a self -storage use which is of low intensity and is not noise sensitive to the San Diego Freeway, and will not generate a significant amount of traffic. Furthermore, because architectural design is an integral component of the Precise Plan, the proposed project is consistent with the Community Design Element of the General Plan. 2. The subject property has a General Plan noise overlay designation due to its proximity to the San Diego Freeway. The noise overlay district permits a mix of zone districts as appropriate, as long as the proposed uses are compatible with adjacent land uses and are not sensitive to noise generated by the freeway. The Precise Plan zoning would permit a self -storage facility which is not sensitive to noise. Also the proposed use will not generate significant negative impacts to adjacent property due to its limited hours of operation and minimal generation of traffic, light and noise. 6-1 DIM 9 MINP�%Ts 7MMrs 7M RE Based upon the findings set forth in Section 1, preceding, the City Council hereby approves Rezone 97-5, rezoning the property to Precise Plan and adopting Precise Plan 97-6, including site design, architecture and landscaping plans, as contained in Exhibit A This Ordinance shall take effect and be in force thirty (30) days after its passage. -1- I1 The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of -ihis Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk. This plan recognizes the need to establish a low intensity, auto oriented land use to serve as a buffer between Interstate 5 and the surrounding residential areas. Standards for this area shall be defined as follows A. Land Use -Land use for this site shall be limited to self -storage facilities no greater than 110,000 square feet. Ancillary facilities, namely a single occupancy apartment and small office, may be permitted as well. B. Hours of Operation The hours of operation for this self -storage facility shall be from 8:00 a.m. to 6:00 p.m., seven days a week. On-site management shall make the facility accessible to patrons on a 24 hour basis in the event of an emergency. C. Architecture -All structures shall be designed in a specific style of Spanish architecture consistent with the City's Architectural Design Guidelines. D. Setbacks All structures shall be set back a minimum of thirty (30) feet from north and south property lines. E. Building Hei¢ht-Building height shall be no greater than twenty-five (25) feet measured from finish grade to top of wall. This provision is expressly intended to preserve street/freeway views of hillside areas surrounding the site. Terracing of building pads, commensurate with the Hillside Management (HM) guidelines of the Land Use Code, may be permitted in this area. F. LiEhtinY-On-site fighting shall be limited to fluorescent wall -pack fixtures pursuant to the lighting plan submitted for Planning Commission approval. These fixtures shall be mounted below the line of sight of surrounding roadways and properties. Light levels shall maintain consistency with the requirements of Land Use Code Section 9-3.614. G. LandscaninQ-Significant landscaping shall be provided along the western side of the site with the intended purpose of filly screening structures from street views. Accordingly, large trees with dense foliage will be encouraged. Throughout the site, indigenous plantings shall be utilized. H. Hillside Management -Pursuant to the objectives of the Elkins -Yates Special Study Area, special care shall be taken to maintain the suffounding hillsides in an undisturbed state. Grading shall be limited; where grading is necessary, contour grading shall be employed. All disturbed slopes shall be replanted with native plant species compliant with Land Use Code Section 9-3.628, "Vegetation Fuel Modification". EXHIBIT A HE I. Engineering Requirements -As part of any new construction project proposed for this site, the following conditions must be fulfilled: Prior to the issuance of grading permit, the proposed project shall pay to the City, its fair share percentage contribution for the following off-site improvements: a. Traffic signal and intersection improvements at San Juan Creek Road/Valle Road. b. Valle Road improvements/widening from San Juan Creek Road to La Novia Avenue. C. Valle Road improvements/widening from its southerly terminus to La Novia Avenue. d. Traffic signal and intersection improvements at Valle Road/La Novia. e. Realignment of La Novia Avenue to intersect with I-5 freeway northbound ramps at Valle Road. f. Reimbursement for the completed section of La Novia Avenue constructed by Glendale Federal Bank, in accordance with the Reimbursement Agreement between the City and Glendale Federal Bank dated December 5, 1989. g. Widening of La Novia Avenue from the Glenfed R.V. lot to Valle Road. 2. The applicant shall submit to the City Engineer for review and obtain approval for a Water Quality Management Plan (WQMP), specifically identifying structural and non-structural Best Management Practices (BMP's) that will be used on-site to control predictable pollutant runoff. The applicant shall submit to the Engineering and Building Director for review and obtain approval for grading plans prepared by a Registered Civil Engineer. These plans shall show the limits of grading, drainage and sewer. The extent of the topography shall be extended enough to deten nine the drainage impact to adjacent properties. All runoff must be contained within the subject property and then conveyed to a City -approved drainage facility.
